On 4/28/25, Licensing Program Analysts (LPAs) Joseph Pacheco and Aurelio Mendoza conducted an unannounced Case Management inspection and met with Licensee, Nancy Fuller. LPA toured the inside and outside of the facility. Licensee is requesting a capacity decrease from 68 to 48 preschool children ages 2 to entry into first grade. Facility is requesting to operate in the red room and orange room. Facility is also requesting to operate in the blue room with an additional capacity of 24 preschool children during the hours that school age children are not present at the facility. This program currently operates year round Monday – Friday 6:30 am – 5:30 pm. This facility also has a school age license 103808968 and infant license 103808969. Licensee stated that facility provides all meals and snacks unless parents decide to provide their children’s food. A physically separate kitchen area was observed that contains a refrigerator, freezer, oven, stove and microwave. Ill children will be isolated in the Director’s office and utilize the staff bathroom. Cleaning supplies are inaccessible to children.
The classrooms were observed to be clean and free of toxins. LPA observed that the furniture and equipment in the classrooms appeared to be safe and in good condition. The facility has working carbon monoxide detectors located in each classroom. LPA observed that there are plenty of tables, chairs, sleeping cots/mats and cubbies. LPA observed plenty of age appropriate items & toys.
Room measurements for all preschool classrooms were taken and reviewed with Licensee. The total inside area of the red and orange classrooms measured to an approximate 1,690 square feet which will accommodate the requested capacity of 48 children. The blue room measured to an approximate 870 square feet which will accommodate 24 additional preschool age children when school age children aren’t present.
There is a total of 4 sinks/hand washing fixtures and 4 toilets which will accommodate the requested capacity. Facility gets drinking water from the sink faucets in each classroom. In the orange room children drink out of sippy cups provided by the facility. In red and blue rooms the facility provides disposable cups for children to .

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

consume water. Children will take water bottles outside during outdoor activities.
LPA observed two outdoor activity areas. Licensee is requesting a waiver to have one of the spaces shared by preschool children ages 3 and up with school age children at separate times. The second outdoor space is used by preschool children age 24 months – 36 months. The outdoor activity area measured to an approximate 11,206 square feet which will accommodate the requested capacity of 48 preschool children. During outdoor activities, the area Licensee is proposing to be shared by preschool and school age, children utilize a drinking fountain for water consumption. In the other area, staff bring water bottles, that are provided by the facility, outside during activities.
High climbing play equipment was observed in both areas. Wood chips are being used for cushioning in one of the areas and rubber cushioning is being used in the other area. Shade is provided by a shade structure and mature trees in both areas. The equipment observed appeared to be age appropriate. LPA reminded Licensee to make sure they maintain visual supervision of children at all times.

A fire clearance for up to 48 preschool children in the red and orange rooms and 72 preschool children in the red, orange and blue rooms was granted by the Fresno Fire Department on 2/28/25.

Pending a final file review and management approval of the requested waivers for the shared outdoor activity space and the waiver to flex the preschool capacity, a recommendation will be made to license the red and orange rooms for a capacity of 48 preschool children and an additional 24 preschool children in the blue room when preschool children are not present.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, no deficiencies are cited.

Exit interview conducted and report was reviewed with Licensee, Nancy Fuller.

A notice of site visit was given to Licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. A copy of this report is to remain in the facility for public review. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
