Licensing Program Analyst (LPA) Julie Baptista conducted an unannounced complaint inspection to provide findings for the above allegation. LPA Baptista met with Raquel Moreno, Office Manager. LPA Baptista reviewed the allegation and toured the facility. LPA Baptista observed 33 children and 6 staff. 14 preschool children were playing in the preschool classroom and the other 19 children were playing outside in the preschool play areas.
During inspection on 8/17/2023, LPA observed two teachers with 13 children in the school age classroom. The children in care were infant toddlers (under 2 years of age), preschool age and school age. Three children were watching television in one corner of the room. LPA observed five school-age children sitting at a table, talking to each other. Other children, who ranged in age from infant/toddler to school-age, were walking from area to area, playing with toys or talking to school age children in the room or talking to the teachers. Staff stated that in the early morning times between 5:45 AM and 7:30 AM the children are supervised in the school age room together until other staff come and get the children to go to their main classes and the school age children are taken to school. During the course of this investigation, LPA made observations, reviewed records, and conducted interviews. Based upon LPA Baptista’s observations, and information gathered through interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

Per California Code of Regulations, Title 22, Division 12, Chapter 1, this deficiency is to be cited. Exit interview conducted with the Office Manager, Raquel Moreno. Plan Of Correction/Appeal Rights were given and discussed. A Notice of Site Visit was posted on parent board in the presence of LPA Baptista.

Limitations on Capacity. A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement is not met as evidenced by LPA observation of toddler, preschool, and school age children being supervised in the same classroom during visit on 8/17/2023.

Director stated she would submit a waiver to have preschool and school age children be supervised in the same classroom only during specific times of the day. Director agrees to create an action plan to have staff receive preschool children in a different classroom than school age children until such a time as waiver is approved. Director agreed all infants will be taken to the infant classrooms upon arrival and not be received in the preschool or school age classrooms.

During inspection LPA observed children in care who were infants, preschool age, and school age comingling in the school age classroom. This poses a potential risk to the health, safety, or personal rights of children in care.
