In regard to the allegation indicating “child injured while in care”, multiple interviews and record review was conducted. Interviews and record review revealed that on 2/14/2022, child #2 sustained multiple wood splinters on both his/her feet due to being allowed by staff to walk barefoot on an area filled with wood chips in the accessible play yard. Per interviews obtained, the activity was spontaneous and involved multiple children being allowed to walk barefoot on the wood chips after they had mud play in the sand, causing child #1 to sustain multiple wood splinters.
In regards to the allegation indicating “facility did not report incidents with authorized representative”, multiple interviews revealed that the facility did not report an incident to the authorized representative in which child #1 was hit on the left side of his/her head by child #2 while child #2 was swinging on a swing. Per interview, this incident occurred on or about early February 2022. The exact date is unknown as there was no internal documentation by the facility. Per multiple interviews, child #1, showed he/she was hurt by the hit directly after the incident (crouched down and cried for approximately 5 minutes). Due to the facility not informing the authorized representative, the authorized representative could not have assessed whether child #1 needed a medical assessment or further observation at home.
This agency investigated the complaint alleging that “child injured while in care” and “facility did not report incidents with authorized representative” and has determined that the complaint allegations were SUBSTANTIATED, meaning the preponderance of evidence standard has been met.
An exit interview was conducted with Director Joslyn Dixon. Today, LPA Ocegueda reviewed Reporting Requirements and Personal Rights.
Per California Code of Regulations, Title 22, Division 12, Chapter 3, the following deficiencies were cited today: (see 9099-D). Appeal Rights were provided today. Notice of Site Visit LIC 9213 must be posted for 30 days. |
