On 08/15/2023, Licensing Program Analyst (LPA) Aurelio Mendoza and Licensing Program Manager (LPM) Cynthia Brannon conducted an announced Case Management-Licensee Initiated Inspection for the preschool license. LPA and LPM met with Director Sal Fonseca. Facility is located on the campus of Washington Unified School District’s West Fresno Elementary, 2910 S Ivy Ave, Fresno, CA 93706, and was constructed in 1954. Director Sal Fonseca verified facility phone number is (559) 495-5615. The purpose of today’s inspection was due to licensee requesting a change of location. The facility is requesting care capacity for 23 preschool children, ages 2-6 years old. The preschool will operate from Monday through Friday on a traditional school year, August through June. The hours of operation are Monday through Friday, from 8:00 am to 11:00 am (morning session) and from 11:30 am to 2:30 pm (afternoon session).

A tour of the facility was conducted both inside and outside. The preschool will utilize Room 4. Staff are aware that they must provide 100% care and supervision when children are using the playground.

Breakfast and lunch will be provided by the school in the cafeteria. There is a kitchen on site where food can be prepared and stored which is in an off-limit area. Staff will utilize the staff bathroom which is located near Room 4. Ill children will be isolated in the front office with school nurse. There is a restroom in the nurse’s office for ill preschool children.

Room 4 was observed to be clean and free of toxins. LPA and LPM observed that the furniture and equipment appeared to be safe and in good condition. There are enough tables, chairs, cots, and plenty of toys for children to play. LPA and LPM reminded Director Sal Fonseca to not store anything on top of high bookcases that could potentially fall on children. There is a working carbon monoxide detector inside Room 4.

Currently, there is construction on site, next to the outside play area. There is temporary fencing due to construction. The gate leading into the outside play area has been removed and will be installed in about three weeks. Staff will provide adequate supervision to ensure preschool children do not leave the outside play area. There is fencing around the elementary school. Per Director Sal Fonseca, this facility is temporary. Construction is taking place for new preschool building which will be completed next year. Licensee will provide a change of location application to ensure a smooth transition. LPA and LPM reviewed time frames with director.

LPA and LPM reviewed with Director Sal Fonseca that furniture is to be anchored or situated so that tipping does not occur. Classroom changes of furniture shall be situated that 100% visual supervision is always provided to children in care.

Room 4 measurements were taken and reviewed with Director Sal Fonseca. The total inside preschool area measured to an approximate 808 square feet which will only accommodate the requested capacity of 23 preschool children at a time. There is adequate storage space available for children's belongings in the classrooms. Director Sal Fonseca understands that children's equipment needs to accommodate the licensing capacity of 23 children. Toys and equipment appear to be age appropriate. There is a total of five toilets and four sinks/hand washing fixtures which will accommodate the requested capacity of 23 preschool children. There is one toilet and one sink in the classroom. Preschool children will have access to the elementary school age restroom. Licensee has requested a restroom waiver. Water will be made accessible for children via water delivery service and will include single use disposable cups for children. The water fountain inside the classroom will be inaccessible to children for use to comply with lead water testing regulations.

The outside play area for the preschool was measured today and it was found to consist of 9387 square feet, which will meet the requested capacity of 23 preschool children. The preschool play area is gated all around. LPA and LPM observed age-appropriate climbing structure with different components which is appropriate for the preschool program. There is an age-appropriate sticker on the climbing structure. For cushioning, licensee is utilizing rubber foam under artificial grass. There is shade available where children can rest and access drinking water.

A fire clearance was approved and granted by the City of Fresno Fire Department on 08/14/2023.

PIN 22-06-CCP Lead Testing FAQ; PIN 21-21-CCP

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first test. This requirement does not apply to licensed Family Child Care Homes.

Health and Safety (HSC) Code section 1597.16 authorizes the Department to implement and administer the health and safety requirements related to lead exposure and testing at CCCs through written instructions until it adopts regulations under the Administrative Procedure Act.

This facility will be providing an attestation letter for the lead water testing. Per, Director Sal Fonseca, children will not be utilizing the water fountains inside and outside for drinking purposes. To ensure that the children are not drinking from the outside water fountains, a colorful trash can will be placed on the outside water fountains. Staff will ensure that the trash cans will be placed and removed when preschool children enter and leave outside play area.

This facility does not plan to provide Incidental Medical Services – IMS. Director Sal Fonseca was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

This facility does not provide infant care at this time.

The following items must be completed prior to issuing a license by 08/15/2023:

1. Replace foam and artificial grass by monkey bars and in front of two side-by-side slides.

2. Remove spider webs from plants by outside play area.

3. Address condensation from air conditioner pipe dripping from roof onto play area.

4. Letter of Attestation for the drinking water stating that facility is utilizing water delivery, along with copy of water delivery contract.

5. Picture of igloo with disposable cup dispenser and disposable cups.

6. Letter of Employment Verification for Liliana Rubio

7. LIC 500 (Employee Roster)

8. LIC 610 (Emergency Disaster Plan) with two relocation letters

9. Orientation Certification for Component 2 (Operations and Record Keeping) for Liliana Rubio

10. Provide the specifications for the artificial grass and rubber foam cushioning.

LPA and LPM reviewed with Director Sal Fonseca, the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Upon receipt and review of documentation, a recommendation to license a preschool center with a capacity of 23 preschool children will be made.
