On 9/10/24 at 8:00 am, Licensing Program Analysts (LPAs), Joseph Pacheco and Ka Vang conducted an announced Pre-Licensing inspection for a new license. Upon arrival, LPAs met with Director, Beth Nelson. Applicant is Fresno Learning LLC and they are requesting to be licensed for 122 preschoolers ages 2-6 in classrooms 5 - 11 and 40 infants ages 0-2 in classrooms 1 -4. Hours of operation will be Monday – Friday 6:30 am – 6:30 pm. This facility will operate year-round.
All indoor and outdoor activity space utilized for the children was inspected today. LPA informed Director that staff are required to maintain direct visual supervision of the children at all times during indoor and outdoor activities. When medications are on site, Director stated that they will be in a cabinet in the Director’s office. A fully equipped first aid kit is located in the reception area and in a red backpack in each classroom. There is an operational carbon monoxide detector on site as part of the built in fire prevention system. All required licensing documents were observed posted in the front lobby area. Children will be signed in and out at either the receptionist desk or in the child’s classroom via an electronic application.
LPA’s continued to tour the facility and measured all indoor and outdoor activity space. Total indoor activity space measured for all preschool classrooms measured to an approximate 4,217 square which is sufficient to accommodate up to 120 preschool children. Applicant will be amending its application to 120 preschool children. Total indoor activity space measured for all infant classrooms measured to an approximate 1,484 square feet, which is sufficient to accommodate the requested overall capacity of 40 infant children. LPA observed all indoor activity space to be complete with safe, age-appropriate furniture and equipment, including tables, chairs, cubbies, napping mats, cribs, bookshelves, and other activity supplies for the children. Infant toys are safe with no sharp edges, splinters, or points, nor made of small parts that can present a choking hazard. Drinking water is available in the classrooms via water provided by a water vendor service to fill pitchers located in each classroom. Children bring their own water bottles from home, but the facility keeps cups on hand in the event a child does not have a water bottle. LPA observed all hazardous items to be inaccessible to children. Ants were observed near the changing table in Classroom 11 (Pre-K). There are no bodies of water or weapons on the property.

Fire clearance for 40 infants ages 0-2 and 122 preschool children ages 2-6 was granted on 8/5/24 by the City of Fresno Fire Department.
In the infant rooms high chairs and feeding tables have broad-based legs, plastic seats are in good repair and trays lock onto chairs. High chairs are made of washable, moisture-resistant material. Changing tables have at least 1” padding covered with moisture-resistant, washable material. Sides of the changing table are at least 3” high and the changing table is within arm’s reach of a sink. Diapering sink is not used for meal preparation or dishwashing. Cribs meet regulatory requirements. Crib area is separated from activity space via a see through partition. This barrier is at least four feet high, made of sound absorbing material and allows for supervision of napping children. Sleep logs, Infant Needs and Services Plans and Sleep Plans are kept in the child’s file in the classroom.
LPA observed a total of 18 sinks and 9 toilets available for preschool children’s use. LPA observed a total of 9 sinks and 3 toilets available for infant children’s use. These are sufficient to accommodate the requested overall capacity of 120 preschool children and 40 infant children. Facility will not be providing potty training for infant children but will provide potty training services for preschool children. There are two separate staff restrooms located in the hallway each equipped with a toilet and a sink. Ill children will be isolated in an area adjacent to the receptionist desk and utilize one of the two adult bathrooms in the hallway.
Director stated that the program offers breakfast, lunch, PM snack. Food is prepared on site. Parents will provide infant formula and diapers. The kitchen area currently includes a refrigerator, freezer, microwave and crock pots for heating food. The kitchen area and food storage areas were observed to be free of rodents and/or vermin. Food was observed to be properly stored separate from cleaning materials. Hazardous items in kitchen are inaccessible to children via the kitchen being locked from the outside.
The facility currently has a fully fenced playground area for each component. Chain link and wood fencing is at least four feet high. The total square footage for all the outdoor activity space for the preschool is approximately 9,925 square feet which is sufficient to accommodate the requested capacity of 120 preschool children. The total square footage for all the outdoor activity space for the infants is approximately 2,484 square feet which is large enough to accommodate a maximum of 34 infants at one time. A playground waiver to share the playground at different times in the AM and PM due to limited square footage shall be submitted for the infant outdoor space and approved prior to licensure. Shade is provided via shade umbrellas on play equipment and a shaded picnic area in both the infant and preschool outdoor areas. There are sufficient outdoor age-appropriate toys and play equipment available on the playgrounds. There is a climbing structure on the preschool playground for children ages 2-12 according to the manufacturer’s sticker. which is properly anchored.

There is a climbing structure on the infant playground for children ages 6 weeks – 24 months according to the manufacturer’s sticker which is properly anchored. There is adequate cushioning in fall zones of each climber provided by synthetic grass with cushioning underneath. Drinking water is available via a water fountain in each outdoor area. No hazardous items were observed in either outdoor play area. Applicant was reminded that any changes to the facility must be reported to and approved by Community Care Licensing.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

This is a brand new constructed facility built after January 1, 2010 and is not currently subject to lead testing requirements for water used for drinking and cooking at this time.

Director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

LPA reviewed with Director the LIC 311A, Records to Be Maintained at The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Director was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. The following corrections are needed prior to the issuance of a license for the infant and preschool component:

Inside Facility:

1) Remove ants from Room 11.

Director, Beth Nelson understands that all proof of corrections must be provided to the Department within 30 days, or the application may be denied.

Pending a final file review, completion of the above item and approval of the waiver for the infant outdoor activity area, a recommendation will be made to license the above facility for the requested capacity of 120 preschool children, and 40 infant children.

Exit interview conducted and report was reviewed with Director, Beth Nelson. A copy of this report is to be kept in the facility for public review.
