32 | Pre-licensing records revealed that the original facility sketch that Licensee Rios submitted documented the home with a 3-car attached garage, that was consistent with real estate listings. LPA Herrera observed that the initial facility sketch did not reference a converted garage.
On 01/10/2020 an updated facility sketch was submitted by licensee, showing that the garage had been converted into an interior living space to be used as a day-care room. However, LPA Herrera did not observe a permit on file for the converted garage.
LPA Herrera obtained pertinent information from Firebaugh’s Building Department that confirmed that day-care home did not have a permit on file for a garage conversion. Furthermore, LPA Herrera obtained and reviewed public real estate listings when the home was purchased that described the home as a 6-bedroom, 3.5 – bathroom home with a 3-car attached garage, further confirming that the home was not originally purchased with a converted garage as licensee disclosed.
The preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED.
Per California Code of Regulations, Title 22, Division 12, Chapter 3, a Type B deficiency is being cited on the attached LIC 9099D. An exit interview was conducted with Licensee Audelia Rios. A copy of this report and Appeal Rights were provided and discussed with Licensee Audelia Rios. A Notice of Site Visit Form was posted to parent's board and must remain posted for 30 days.
