25 | On 1/16/2024, Licensing Program Analyst (LPA) Stephanie Vega-Gonzlez conducted an unannounced Case Management inspection at facility that licensee initiated. LPA met with Licensee, Sandra Sauceda who accompanied LPA during tour of facility both inside and outside. LPA explained the reason for the inspection and took a census.
On today’s date LPA inspected the back yard that had a pool. Licensee had installed a metal black fence with a door to ensure children did not have access to the pool. Licensee had informed LPA on 1/12/2024 that the pool fence was ready for an inspection. During the inspection on today’s date, LPA observed that the metal fence height did not reach the required 5 feet in certain areas of the fence. LPA also observed that the fence door did not swing away from the pool or self-close and latched. LPA also measured the gaps between metal bars and observed that they were 4 inches. LPA reviewed findings with Licensee. Licensee stated that fence door coils will be tighten by the end of today’s date, and proof will be submitted to the department. Licensee stated that she will fix fence to ensure that it meets the required 5 feet. Licensee stated that she will be in communication with LPA if she has any further questions or concerns.
LPA reviewed the Community Care Licensing Regulation 102417(g)(5)(A) with licensee. (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.
LPA also watched BODIES OF WATER REQUIREMENTS in CHILD CARE video with licensee.
Per California Code of Regulations, Title 22, Division 12, Chapter 3, no deficiency are cited during today's visit.
