32 | On 5/28/26 and 9/11/26 the home was toured during inspection. On 5/28/26 LPA Curiel and LPA Dutra took photos of the kitchen and living room area. Based on photos, the home appeared cluttered, with items such as boxes, kitchen items, and misc. papers and household items stacked high in corners and on counters, creating potential tripping and falling hazards for children in care. Photos of the kitchen show the kitchen sink full of dishes and the kitchen stove with dried food and grime. On 9/11/26 LPA Laird observed areas in the dining room and kitchen had clutter on the tables and counters. LPA Laird observed food times, cooking items, and household items stacked on counters and tables in areas accessible to children in care.
On 5/27/26 and 8/4/26 six parent interviews were conducted (P1-P6). Of those interviewed, three parents stated the home is cluttered. One parent stated they believe the home has tripping hazards. One parent stated the home is unclean. None of the parents interviewed had knowledge of the licensee yelling at children in care.
On 5/28/26 LPA Curiel and LPA Dutra conducted interviews with 5 children (C1-C5). Of those interviewed, four children denied the home is dirty. All children interviewed stated the licensee yells at them.
On 5/28/26 LPA Curiel and LPA Dutra conducted an interview with 1 staff (S1). S1 denied the allegations stating the home is not cluttered. During the interview S1 did confirm there was clutter in the kitchen due to the licensee recently going shopping. S1 stated licensee does not yell at children in care.
Based on interviews conducted and observations, this department has determined there is sufficient evidence to suggest the allegations occurred.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
