On June 1st, 2023 at 9:15am, Licensing Program Analyst (LPA) Snow S.Sims conducted an unannounced complaint inspection and met with licensee Shirlyn Berlin. The Licensee had send an incident report to the LPA on 5/17/23 anticipating a complaint.
It was alleged that Licensee is operating out of ratio; specifically, that the licensee has been alone at least 2 days with 7-8 children with 4 of them being infants; On June 1st, 2023 at 9:15am the licensee demonstrated an understanding of the required limits. Upon arrival LPA observed that the licensee had 3 children (2 infants and 1 age 2) during the inspection the licensee received a text from a parent and agreed to take a drop in infant who was dropped off at 10:15am (three infants and one 2-year-old= 4 children). On 7/19 at 8:45am the LPA observed the licensee supervising 8 children (2 infnats/3preschool/3 school age) and within ratio. She said her staff/assistant will be here before the school age children arrive. The licensee does a lot of drop in care; she checks her ratio before letting them know if they can come. 6 witnesses including 4 parents and 2 staff were interviewed and all denied the allegation stating that they have never seen the licensee alone with more than 8 children and that they have only ever seen 2-3 infants at the facility.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted. The Notice of Site Visit must be posted for 30 days.
It was also alleged that the facility is dirty; specifically, the kitchen floor is full of debris. The floors appeared adequately clean on inspections June 1 & July 19, 2023. On June 1 the LPA inspected the floor and could only find a couple of pieces of sausage under a highchair; they had a meal a half hour prior and children were not playing near the highchairs. On 7/19 the LPAs observed a clean floor with no debris. On June 1st, 2023 at 9:15am the licensee denied having dirty or hazardous floors and said she tries hard to keep the floor clear. 6 witnesses, including 4 parents and 2 staff were interviewed and all denied the allegation that the floors were dirty.
Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted. The Notice of Site Visit must be posted for 30 days.
It was also alleged that the Licensee does not adequately supervise day care children in care; specifically, that she is unable to watch the older children because she is overwhelmed with 4 infants or doesn’t have an assistant. On June 1st, 2023 at 9:15am the Licensee denied this and denied feeling overwhelmed and said she uses an assistant as needed. The LPA did not observe any chaos and the supervision appeared adequate during the inspections on June 1 and July 19, 2023. 10 witnesses, including 4 parents, 4 children and 2 staff were interviewed and none of them corroborated the allegation stating that the children were watched by the licensee.
Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted. The Notice of Site Visit must be posted for 30 days.

It was also alleged that Licensee did not ensure that day care child's toileting needs were being met, specifically, that an infant had an extremely full (pee) diaper at pickup. On June 1st, 2023 at 9:15am the licensee denied this and stated she has regular checks for changes and potty training. The LPA arrived at 915 am on June 1st and the licensee was just finishing a diaper change, The LPAs did not observe any odors during the inspections on June 1 and July 19. 6 witnesses, including 4 parents and 2 staff were interviewed and all denied the allegation.
