32 | LPA interviewed was able to interview 3 of 5 children (C1-C3) on 1/18/24 and 2/26/24. LPA addressed the following allegations. 2 of 3 children stated yes there given spoiled milk. C1 stated that C1 and C2 were given cereal and milk but the milk was bitter. C1 stated that C1’s stomach was hurting C2 ate three spoons of their cereal. C2 stated they did not like the cereal because it was waxy and bitter. C2 stated that they did not finish their cereal. 2 of 3 children stated yes food was withheld from them. C1 stated that their parent had packed lunch for them, but they did not eat much from what was packed. C2 stated that they did not like the food, they were given maruchan (cup of noodles) soup and did not eat. C2 stated they had goldfish crackers. 2 of 3 children stated yes, the carpet at the facility was unsanitary. C1 and C2 stated that licensee’s dog vomited and peed on the carpet locating in the living room.
LPA interviewed witnesses (W1-W4) on 1/18/24, 1/22/24 and on 1/23/24. 3 of 4 witnesses stated no children were not fed spoiled milk. W1 stated that C1 and C2 had disclosed that that there were given spoiled milk at the licensee’s home. 3 of 4 witnesses stated no, food was not withheld from children. 4 of 4 witnesses stated no they did not witness the carpet in the facility.
On 1/24/24 LPA observed on milk in the fridge and checked the expiration date on the milk and LPAs smelled the milk and it did not smell spoiled neither did the milk look curdled. LPAs observed no visible stains in the living room carpet and no odors were detected.
During today’s visit facility was toured and LPA observed 4 children in care napping. On 4/16/24 LPA did not observe any stains on the carpet located in the living room.
Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted. The Notice of Site Visit must be posted for 30 days. |
