On 11/07/2023 at 1 PM a closing complaint investigation visit was made to the facility by Licensing Program Analysts (LPA) K. Lynch and N. Wheeler. It was alleged Licensee left day care children unattended, and Licensee is out of ratio. The Licensee was interviewed and denied the allegations and stated children are never left unattended by staff, and they always maintain staffing ratios per regulations. Two staff (S1-S2) were interviewed on 09/20/23 and 11/06/23 and there were no disclosures. Three children (C1-C3) were also interviewed on 09/20/23, and there were no disclosures. Six parents/guardians were interviewed on 09/05/2023, 11/01/23, and 11/02/23 and there no disclosures supporting the above allegations. During the investigation, LPAs observed adequate care and supervision provided to children by Licensee and staff, and staffing ratios were also maintained per regulations during the visits. Based on observations and interviews during the complaint investigation, the allegations are unsubstantiated. Although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, and the findings are unsubstantiated. Exit interview was conducted, appeal rights provided, and notice of site visit posted.

On 11/07/2023 at 1 PM a closing complaint investigation visit was made to the facility by Licensing Program Analysts (LPA) K. Lynch and N. Wheeler. It was alleged Licensee did not make sure safety gates were locked. The Licensee was interviewed and denied the allegation, and stated both exterior gates are latched with child safety latches to keep children from leaving the exterior playground area. Two staff (S1-S2) were interviewed on 09/20/23 and 11/06/23 and there were no disclosures. Three children (C1-C3) were also interviewed on 09/20/23, and there were no disclosures. Six parents/guardians were interviewed on 09/05/2023, 11/01/23, and 11/02/23 and there were no disclosures. During the investigation, LPA observed exterior safety gates were latched and in working order; however, LPA observed the interior safety gate for the stairs to the off-limits upstairs area leading to the front door of the home had a broken latch and was easily opened by LPA. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22 is cited on the attached LIC 9099-D. Exit interview was conducted, notice of site visit posted, and appeal rights were provided.

Licensee stated she would fix the gate during the intial complaint opening visit, and emailed proof to LPA. LPA also verified gate was fixed with replacement at the time of the closing complaint visit. POC cleared at time of closing complaint visit.

(3) Where children less than five years old are in care, stairs shall be fenced or barricaded.
This requirement was not met as evidenced by: Licensee's home interior stairs child safety gate had a broken latch, and was easily opened by LPA lightly with one hand.
