32 | Staff members interviewed stated that the incident occurred during the transition from the playground back into the facility. Staff stated that although they observed the child get in line, enter the facility, and later saw the child in the bathroom area, they did not ensure the child was supervised at all times. As a result, the child was ultimately found outside on the playground alone and unsupervised for an unknown period of time.
On March 25, 2026, the Department also received a self reported Unusual Incident Report from the facility describing the incident. The report states that a day care child was left outside on the playground and was brought inside by a staff member who is also the child's authorized representative.
Based on interviews conducted, information gathered from the Unusual Incident Report, and acknowledgment from the facility representative and staff that the incident occurred, the preponderance of evidence standard has been met. Therefore, the allegation that staff failed to ensure a child was supervised at all times is SUBSTANTIATED.
Per California Code of Regulations, Title 22, Division 12, Chapter 1, one (1) Type A deficiency is being cited on the attached LIC 9099D. A $500 Civil Penalty for absence of supervision was issued. Refer to LIC 421IM.
LPA Oscar Picazo informed facility representative, Maria Isabel Silva to provide a copy of this licensing report dated June 11, 2026 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days.
