25 | On 03/27/23 at 12:00PM, LPA Luigi Gargaro conducted an unannounced follow up case management visit to the facility regarding a previously self-reported inappropriate child discipline incident. Based on testimony and video recorded documentation obtained and reviewed by analyst, it was determined that there was insufficient evidence to conclusively indicate that a violation occurred during an interaction between staff member #1 and child #1 at the time of the 02/28/23 incident.
In his investigation of the incident, analyst found that the reporting witness didn’t actually visually witness what she stated occurred and the facility recording during the time of alleged incident was from a camera that did not capture the area where the incident was reported to have happened. Due to the inconclusive evidence, no violations were cited against the facility regarding the reported event.
An exit interview was conducted and the report was reviewed with site supervisor Arayanzis Trejo. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
