On 06/16/2026 at approximately 10:00 a.m., Licensing Program Analyst (LPA) Julieta Abrego conducted an unannounced complaint inspection for the purpose of delivering the complaint findings for the above listed allegations. Upon arrival, LPA met with the Director Carolina Gonzalez and proceeded to tour the facility. During the inspection there were five (5) children in care with one (1) staff member (the Director) present.

During the course of the investigation, records were reviewed, and interviews were conducted with the director, witnesses, children in care, and daycare parents.

It was alleged that staff inappropriately suspended a daycare child (C1). The director admitted that C1 did not do anything to merit a suspension and had no behavioral concerns. The licensee stated that the child was suspended due to an incident earlier that morning on 03/19/2026 involving an alleged altercation with C1’s authorized representative not because of the child’s behavior.

No staff were interviewed, as the Director is the sole individual providing care and supervision for children at the facility. Daycare children interviewed stated they did recall the incident and reported that it was the Director who had mentioned it to them. Child (C5) recalled hearing a parent raise his voice and stated that it was the Director who told her about the situation.

According to daycare parents interviewed, one parent present during the incident reported that he did not witness an altercation but observed a frustrated authorized representative expressing concern and denied seeing any inappropriate behavior from C1. Other parents stated the Director informed them about the incident and referred to it as a “disagreement.”

It was also alleged that the facility did not follow the terms and conditions set forth in the admission agreement. No staff were interviewed, as the Director is the sole individual responsible for the care and supervision of children at the facility.

During the investigation, it was determined that C1 was sent home from care on 02/03/2026 due to illness, and the facility requested a doctor’s note in accordance with the admission agreement. The agreement states that any child or adult who has been absent as a result of a communicable disease or illness may not be re admitted to the classroom until there is written assurance from a physician or medical professional that the individual no longer has any evidence of communicable illness. The parents obtained a doctor’s note clearing C1 to return on 02/10/2026; however, the parents informed the facility that C1 would remain out due to a low grade fever and a positive test for Influenza Type A. The parents reported that the physician advised C1 could return once fever free for 24 hours, and the facility requested an updated doctor’s note.

Parents interviewed stated that on 02/12/2026 at 4:46 p.m., the Director notified families that the facility would be closed on 02/13/2026 because only one child would be attending. Records showed that, following C1’s exclusion from care due to illness, C1 was the only child scheduled to attend on 02/13/2026. The Director subsequently notified parents that the facility would be closed that day. Parents stated they were unaware of any minimum enrollment requirement. Record review confirmed that neither the admission agreement nor the Parent Handbook contained any provision allowing the facility to close based on attendance or a minimum number of children.

Based on interviews, parent interviews, messaging records, and review of the admission agreement, Parent Handbook, and Plan of Operation, the facility did not follow the terms and conditions set forth in the admission agreement regarding the illness policy. In addition, the facility suspended a child from care despite the Parent Handbook and Plan of Operation containing no provision for child suspensions, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, title 22, Division 12 & Chapter 1, is being cited on the attached LIC 9099D.
