On November 13, 2023 at 10:45 AM, Licensing Program Analyst (LPA) Gloria Gonzalez conducted an announced prelicensing inspection with applicants, Lucia Cardenas & Karina Reyes. LPA disclosed the purpose of the inspection and was granted a tour into the facility by the Applicants. Purpose of the inspection is to ensure that the home is in compliance with standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. This one story, 3 bedroom, 2 bath home and an attached studio with one bathroom, was toured and inspected. The hours of operation are: Monday through Saturday, 6:00 a.m. to 8:00 p.m.

Applicants will use the following areas for child care: living room, tv room, dining room (daycare area), kitchen, hallway bathroom, and right side of backyard. Off limits areas include: Master bedroom, 2 bedrooms, master bathroom, studio with 1 bathroom, and the left side of backyard. They are made inaccessible to day care children through the use of door locks. The home has a fenced backyard available for outdoor activities at time of inspection.  The home has an electric fireplace. Applicant stated there are no bodies of water and LPA did not observe any bodies of water during the time of this inspection.  The fire extinguisher and smoke alarm meet requirements and are operational. The home does not have a carbon monoxide detector. Applicants were advised all poisons shall be locked. Applicants states detergents, cleaning compounds, and medicines are inaccessible to children in care and are located in off limit areas with cupboard latches and/or door locks and secured out of reach of children.  Children’s toys, material, and play equipment are available. The applicants have a working telephone/cell phone.  Applicants state there are no firearms at the time of this inspection.

Applicants maintains documentation of proof of control of property for review by the Department. Applicant, Lucia has completed the Mandated Reporter AB1207 training certification on 8/7/23 and Karina on 8/5/23. Applicanta were advised that all helpers will need to complete this training. Applicants have completed the 8 hours of preventative health. Pediatric CPR and First Aid certifications expire on 8/2025.

Applicants were advised all helpers will need to complete this training if left alone with children. Required documents are posted.  Applicants and adult residents in the home have criminal record clearances on file.  Applicants, were reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

LPA advised that prior to making alterations or additions to the home or grounds, the applicants shall notify the Department of the proposed change. Applicant states they are financially secure to operate a family child care home for children and will comply with all regulations and laws governing family child care homes.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The New Provider Resource Packet was reviewed with the applicants including information on the following:  Lead Exposure, SIDS, shaken baby, child abuse reporting, community resources, LIC311D, children’s records, facility records, required postings, immunizations, unusual incident report, facility roster, car seat law, visual for ratio/capacity, fire/disaster drill log. Entrance Checklist was provided to the applicant. Applicants were also informed the following items are prohibited during day care operating hours (walkers, exersaucers, jumpers and bouncy seats). Corporal punishment and smoking are not allowed in the day care.

On this date, 11/13/23, the California Attorney General - Megan’s Law website (meganslaw.ca.gov) was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

LPA discussed the safe sleep regulations with applicants and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep, as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA discussed the maximum capacity for a small family child care home: four infants only (infants mean any children under 24 months); or six children with no more than three infants; or, with landlord consent, eight children with no more than two infants, one child in kindergarten or elementary school and one child at least age six, including children under age 10 who live in the home. It should be noted that Landlord Consent, (LIC 9149), is not on file.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. Applicant was encouraged to subscribe through the CCLD website in order to be placed on an email list for updated regulation information.

The applicant provided proof of control of property.

The following corrections are needed prior to the issuance of a regular license:
  • The home shall contain a Carbon Monoxide Detector.

An exit interview was conducted and this report was reviewed with the applicants, Lucia Cardenas & Karina Reyes. 

Applicants states corrections will be completed by 11/14/23. Once correction has been made a Small Family Child Care Home license may be issued upon final file review. A copy of the report and appeal rights (LIC 9058) was provided to the applicants.
