On 11/01/22 Licensing Program Analysts (LPAs) Daniel Alvarez, Jessika Thompson and Licensing Program Manager Susie Fanning conducted an unannounced case management inspection. LPA Alvarez met with Head Teacher Rita Delgado who accompanied LPAs on a tour of the facility, and a census was taken. The purpose of today's inspection is to address the lead exceedance, referred to as an Action Level Exceedance (ALE) of over 5.5 parts per billion (ppb) in the water at the facility.

The Fresno South Regional Office received notification of water lead exceedance at the facility resulting from a water lead sampling test collected on 09/17/2022. Records were reviewed from Enthalpy Analytical and discussions with Head Teacher Delgado, it has been determined that there is an exceedance to outlets (F) and (K) in the facility. LPA Alvarez inspected outlet (F) it was observed to be a hallway drinking fountain that was impacted with 5.7ppb (ALE) of lead. LPA Alvarez also inspected outlet (K) it was observed to be a drinking fountain in room 12 that was impacted with 8.3ppb (ALE) of lead. Head Teacher Delgado stated that outlets (F) and (K) have not been in use since COVID. Furthermore, has made both outlets inoperable to both preschool and school-age children by placing a sign on the faucets and outets have been wrapped not to use until faucets have been fixed. Head Teacher Delgado stated that all drinking water is being obtained from the kitchen faucets which had a “none detected” level, the water is put into Igloo containers for each classroom and children use either their own water bottles and/or disposable cup as needed. While at the facility LPM Fanning spoke with Director Erin Wilcox over the phone who stated she is working with the Church Board and California Rural Water Association to fixed both outlets.

(See plan of correction for further corrective action 809D). Facility has already notified all the authorized representatives of this corrective action in English.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809D). Head Teacher Delgado was provided a copy of the appeal rights. An exit interview was conducted with Head Teacher Delgado.
This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

101700.3 California Lead Action Level at Child Care Centers (a) California’s Action Level for lead in water at Child Care Centers is 5 ppb. (b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. (c) If testing indicates an Action Level Exceedance at any water outlet, the water from that outlet is deemed not safe to drink and an immediate response pursuant to section 101704 shall be required.

Per Director Erin Wilcox, authorized representatives have been notified of the lead exceedance and testing results. Both outlets have been made inoperable. Director states she is working with the church Board and California Rural Water Association for remediation and retesting.

This requirement was not met evidence by: Based on record review provided by Enthalpy Analytical, a result of (ALE) of 5.7 ppb for outlet (F), and a result of (ALE) of 8.3 ppb for outlet (K) which are out of the compliance over the allowable (ALE) of 5.5 ppb. This poses a potential health, safety, or personal rights risk to persons in care.
