On 09/11/2023, Licensing Program Analyst (LPA) Candis Rodriguez conducted an unannounced complaint inspection at facility. LPA met with Assistant Director Haley Harl and Director Ashley Herrera, explained purpose of inspection, toured facility and took a census.
During today's inspection, LPA observed Teacher #1 alone with 14 children, which is out of ratio. LPA interviewed Teacher #1 and Teacher #2 and determined Teacher #1 was left alone with 14 children for up to two minutes. LPA observed majority of children were laying down to nap, but one child was playing quietly at a table, and Teacher #1 was assisting one child to lay down. When LPA observed the class out of ratio, Assistant Director Haley Harl immediately transferred two children to another class, bringing the class back into ratio.
Based on observation and interview, investigation revealed facility was operating out of ratio. Therefore, the preponderance of evidence standard has been met, and the allegation is found to be Substantiated.

Director agreed to conduct a training with all staff regarding ratio and capacity requirements, and the importance of communication between all staff to ensure no classrooms are out of ratio at any time for any period of time.

Based on observation and interview, facility did not ensure Teacher #1 was within ratio as they had 14 children in their classroom at one time. This poses a potential risk to the health, safety, and personal rights of children in care.

Director agreed to submit an outline of the training conducted, along with staff signatures and dates acknowledging requirements, to CCL by POC due date 10/02/2023. Facility immediately moved two children to another classroom bringing class into ratio during inspection.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (See LIC 809-D). Licensee was provided a copy of their appeal rights.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
