25 | On 3/29/2022, LPA Jose Penate arrived at facility to conduct a Case Management inspection due to a previous inspection visit. LPA Penate spoke with Assistant, Heidi Soliz and discussed the purpose of the inspection. A tour of the facility was conducted both inside and outside and census was taken.
Based on observation by LPA on today’s visit, upon arrival LPA observed Licensee Maria Rodriguez leaving the home and was unable to make contact. LPA also observed assistant accompanying 5 children while at an outdoor walk through the neighborhood. LPA then made his way to the home and was greeted by another assistant, upon entry of the home LPA immediately took a census and counted 16 children that were left alone with assistant. LPA asked assistant if she was aware that she was over ratio and she said “no, the other assistant is outside with 2 other children”. LPA then proceeded to go outside to speak with other assistant and confirmed that she did in fact have 5 children with her and that made a total of 21 children in care.
While walking towards Assistant and children, LPA observed the assistant having difficulty with all 5 children holding hands. Due to the children not holding hands the assistant got upset with 1 child and aggressively slapped the child on top of the hand. LPA then advised assistant that what he observed was not allowed and that the personal rights of the child were broken. LPA then told her that she should be using a different method of communication rather than hitting children.
Per California Code of Regulations, Title 22, Division 12, the following deficiency is being cited on the attached LIC9099D, see next page.
