On 07/26/2023, Licensing Program Analyst (LPA) Candis Rodriguez conducted an unannounced case management inspection at facility regarding an incident reported to the Department on 07/25/2023. LPA met with Lead Teacher Megan Shaw, explained purpose of inspection and took a census.

On 07/20/2023, Child #1 reported to Parent #1 that Child #2 forced Child #1 to show Child #2 his penis and also touch Child #2's penis in the restroom. Child #1 also stated a similar incident occurred in the classroom on a different but unknown day, where Child #2 was asking Child #1 to touch his penis. Parent #1 notified facility on 07/21/2023.

Facility conducted an investigation, interviewed Child #1, Child #2, and parents of Child #1 and Child #2. Facility determined the incidents did occur. Child #1 was moved to a different classroom to be separated from Child #2. Facility followed mandated reporting protocols. Child #1 returned to the facility on 07/24/2023. Child #2 is also still attending the facility, and facility is working with parents of Child #2. Facility implemented a new policy that only one child can be in the restroom at one time, while a teacher stands outside the restroom. Facility also implemented a new policy that lights must remain on in the classroom at all times, including when children are watching a movie. Facility provided proof that all teachers have acknowledged these policies. Facility also advised staff they should not be distracted (i.e. cellphones) when supervising children.

Based on interviews and record review, it was determined the incident did occur, which is a violation of children's personal rights.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D). Licensee was provided a copy of their appeal rights.

LPA informed Lead Teacher that this report dated 07/26/2023 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA informed Lead Teacher to provide a copy of this licensing report dated 07/26/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with Lead Teacher.

Facility agreed to conduct and send CCL an outline of training on supervision along with list of staff who attended with signatures and date. Facility also agreed to update their policies in their handbook and plan of operation indicating the policy changes, and send to CCL by POC due date (08/18/2023).
