On 4/5/2022, Licensing Program Analyst (LPA) Jessika Thompson conducted a Case Management Inspection. LPA met with Teacher Brenda Castillo. A tour of the facility was made and a census was taken. The purpose of this visit was to address a violation of Title 22 Regulations.

Today, upon arrival, LPA observed Teacher Brenda
Castillo, Staff #2(Teacher), and Staff #3 (Teacher's Aide) caring for a total of 21 children. At approximately 1:20 PM, Teacher Castillo left the preschool classroom and began solely caring for children in the school age program, leaving Staff #2 and Staff #3 to care for 21 children. The facility was found to be out of compliance, as one teacher and one teacher's aide can only care for up to 15 children, or up to a maximum of 18 children when the aide meets the qualifications specified in Section 101216.2.

Additionally, it has been found that although Staff #3 has obtained criminal background clearance, she is not associated to the child care center license as required by the Department.

The following is cited per Title 22 Division 12 of the California Code of Regulations (see LIC809-D).

In exit interview Teacher Castillo was advised of appeals rights and was provided with Appeals Rights.

Teacher Brenda Castillo stated that she will ensure that Staff #3 is associated to the facility as required. Licensee to submit proof of fingerprint clearance association for Staff #3 to the Fresno Community Care Licensing Office by 4/15/22.

During today's inspection it was found that although Staff #3 has obtained background clearance, she is not associated to the child care facility license as required. This poses a potential risk to the Health, Safety, or Personal Rights of children in care.

(b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. This requirement was not met as evidenced by LPA's observations. Today, LPA observed Staff #2 and Staff #3 caring for a total of 21 children (Staff #2 is a teacher, Staff #3 is a teacher's aide).

Teacher Castillo stated the facility's Director, as well as an additional staff member, will return to the facility tomorrow; therefore, there will be adequate staffing to accommodate the number of children enrolled. Additionally, Teacher Castillo stated that additional children will not be accepted once the facility reaches the maximum amount of children allowed per the number of qualified staff present.

Futher, Teacher Castillo stated that the licensee will submit a plan detailing the methods to be utilized going forward to ensure the facility adheres to Title 22 Regulation 101216.3. This plan is to be submitted to the Fresno Community Care Licensing Office by 4/15/22.
