On 04/28/2025, Licensing Program Analyst (LPA) Octavia Nolan and Licensing Program Manager (LPM) Cynthia Brannon conducted an unannounced Case Management inspection and met with Licensee, Amanda Guinn. The licensee is requesting to decrease the number of licensed classrooms from four classrooms to two classrooms (classroom #1 and lunchroom) and license a new children’s restroom. Capacity of 24 preschool children is to remain the same.

This program currently operates Monday through Friday 6:00 AM to 6:00 PM. Licensee stated that the facility provides breakfast, lunch, and snacks to children in care. LPA observed a kitchen on site with a refrigerator, freezer, and a stove. Ill children will be isolated in Director’s office and utilize the staff restroom. Cleaning supplies are inaccessible to children.

LPA toured the facility inside and outside and took a census. There were 12 daycare children present. LPA reviewed sign in/ sign out sheets and observed there were 14 children signed in. LPA discussed with Licensee to follow sign in and out procedures for all children in care.

The classrooms were observed to be clean and free of toxins. LPA observed that the furniture and equipment in the classrooms appeared to be safe and in good condition. The facility has one or more working carbon monoxide detectors. LPA observed that there are plenty of tables, chairs and cubbies to meet requested capacity of 24 children. LPA observed plenty of age-appropriate items and toys.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

the hand rails. The stairs to the playhouse were not sturdy. LPA also observed an 8 inch gap in the fencing that leads to an unlicensed area. The seat to the see-saw is loose and missing a bolt. The wooden poles in the outdoor area need to be sanded and painted.

area of all preschool classrooms measured to an approximate 1085 square feet which will accommodate the requested capacity of 24 children.

Currently, the children’s bathroom is located in the classroom. The other children’s restroom is located at the end of the building. Children access the restroom by going outside and walking down the corridor. There is a staff restroom located in the lunchroom. During today’s inspection, LPA and LPM inspected the children’s restroom located at the end of the building. There were items to be corrected. Licensee requested for the staff bathroom to be licensed as a children’s restroom and have staff use the restroom located at the end of the building. Licensee was informed that the change can be made, however, the current staff restroom will need have all storage items removed. By making the changes, there will be a total of 2 sinks/hand washing fixtures and 2 of toilets which will accommodate the requested capacity. During today’s inspection, LPA also observed decorative supplies and a fire extinguisher being stored on the floor in the children’s restroom located in classroom.

Water is available indoors and outdoors via water dispenser and disposal cups. Director was advised to keep disposal cups in a cup dispenser. Parents also can provide children with water bottles to fill from home. Uncontaminated drinking water is to be accessible in both classrooms and when children are outside playing.

The outdoor activity area measured to an approximate 2468 square feet which will accommodate the requested capacity of 24 preschool children. No high climbing play equipment was observed. Shade is provided by one shade tarp. Per licensee, she is adding another shade tarp to the outside play area. Licensee stated she already has the shade tarp, which will be installed by May 12, 2025. The equipment observed appeared to be age appropriate. During today’s inspection, LPA observed a playhouse outside with chipping paint and rust on the hand rails. The stairs to the playhouse were not sturdy. LPA observed wood rot on the awning in outdoor activity area and there was an 8.25-inch gap between the fencing. The gap is large enough for a child to fit through. LPA reminded Licensee to make sure staff are to maintain visual supervision of children at all times.

A fire clearance for 24 preschool children in both classrooms and the restroom located in the lunchroom will be ordered by the Kern County Fire Department.

The following items must be completed by May 12, 2025 to update areas accessible to children in care:

Indoor Activity Space
1. Remove storage from both restrooms

Outdoor Activity Space
1. Paint and restore the playhouse or remove it
2. Add a post to the fencing to close 8 inch gap
3. Repair wood rot on awning

Pending a final file review and completion of the above items, a recommendation will be made to license the restroom located in the lunchroom and the change the classrooms from four to two for a capacity of 24 preschool children.

Per Title 22, Division 12, Chapter 1 of the California Code of Regulations, the following deficiency is being cited during today’s inspection: (see next page LIC 809D).

Exit interview conducted and report was reviewed with Licensee, Amanda Guinn.

A notice of site visit was given to Licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. A copy of this report is to remain in the facility for public review. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
