On 05/26/2022, LPA Jose Penate arrived at facility to conduct an unannounced complaint inspection to investigate the above allegation. LPA Penate spoke with Administrator, Hayley Simon and discussed the purpose of the inspection. A tour of the facility was conducted both inside and outside and census was taken.

Based on interviews, the allegation of Child was not treated with dignity and respect. Staff #1 stated that she in fact took a child outside of the facility in the nude to hose her down due to the child soiling herself and having lots of feces on her body. Staff #1 attempted to clean child in the restroom but was unable to clean the child entirely and Staff #1 thought that taking the child outside to hose her down was the easier method to clean her entirely.

Based on statements during this investigation; allegation of, Child was not treated with dignity and respect, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

Per California Code of Regulations, Title 22, Division 12, the following deficiency is being cited on the attached LIC9099D, see next page.

Exit interview was conducted with Administrator, Hayley Simon.

A Notice of Site Visit Form was posted and must remain posted for 30 days.

Personal Rights. Each child receiving services from a family child care shall be accorded dignity in his/her personal relationships with staff, residents and other persons. This requirement was not met as evidenced by staff interviews. On 5/18/22, Staff #1, stated that she in fact did take a child out of the facility nude and hosed her down

Although, the intent was not to humiliate the child, the dignity of the child was violated. This poses a potential health, safety or personal rights risk to children in care.
