On 03/08/2024, Licensing Program Analyst (LPA) Lady Cabrera conducted an unannounced complaint inspection at the facility. The purpose of the inspection was to deliver the finding for the above listed complaint allegation. LPA tour the facility with Site Supervisor Rosa Rabago. LPA met with Rosa at the facility’s office. Director Mary Ann Mooney, Program Administrator Letisha Brooks and Director of Head Start Yolanda Gonzales were present via Microsoft Teams Meeting.

During the course of the investigation, LPA Cabrera collected facility records and conducted interviews of facility representatives, staff, parents and children. Based on interviews and witnesses’ observations, it was confirmed that on 01/23/2024 Staff 1 handled day care child in a rough manner. The teacher in question denied the allegation. Facility records showed the teacher in question has been disciplined for mishandling a child on 11/22/2023.

Based upon observations, and information gathered through interviews, the preponderance of evidence standard has been met, therefore the above allegation are found to be SUBSTANTIATED.

LPA Cabrera informed facility representative that this report dated 03/08/2024 documents one Type A citation which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Cabrera informed the facility representative to provide a copy of this licensing report dated 03/08/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Per California Code of Regulations, Title 22, Division 12, Chapter 1, the deficiency is being cited on the attached LIC 9099D.

An exit interview conducted with Site Supervisor Rosa Rabago. A copy of this report and Appeal Rights were provided and discussed with Rosa Rabago.

A Notice of Site Visit Form was posted to parent's board and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

The investigation revealed through interviews and review of records, that although the above allegation may have happened or is valid, there is not a preponderance of evidence at this time to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
