25 | On 11/30/22, Licensing Program Analyst (LPA) Kathy Pacheco conducted an unannounced case management inspection and met with Administrator Raquel Hernandez to discuss an incident that occurred on 11/8/22. LPA toured the facility, took a census, interviewed staff, and observed the area in which the incident occurred.
LPA spoke with teacher (see Confidential Names form (LIC 811) dated 11/30/22) regarding the incident that took place on 11/8/22. Teacher stated she was sitting down in the classroom with other children when she witnessed child #1 pulling the hair of child #2. Teacher said she immediately got up and went towards the children and said "no" to child #1. She said as she was walking towards them, child #1 let go of child #2's hair and child #2 remained on the ground. Teacher said she extended her hand out to keep child #1 away from child #2 and child #2 was putting his hands towards her to be held. Teacher said she got on the floor with child #2 and he began to hug her so she hugged him back and began to console him. She said as she was consoling child #2, she did tell child #1 that it was not nice to pull child #2's hair. Teacher said child #1 listened to her and then walked away. She said at no time did she ever touch, pull, or hurt child #1.
Administrator informed LPA that after the incident, she spoke with all staff and did additional training regarding appropriate ways to speak with the children and different methods of handling these situations.
Based on the information obtained, LPA determined Licensee/facility handled the incident correctly and reporting requirements were met. After interviewing staff, LPA determined Licensee/facility took appropriate measures to address the situation. LPA further determined Licensee/facility followed proper policies and procedures and no regulations were violated. Per California Code of Regulations Title 22, Division 12, no deficiency cited during today's inspection.
A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Administrator Raquel Hernandez. |
