On 11/15/2023, Licensing Program Analyst (LPA) Nancy Her conducted an unannounced case management inspection and met with Director, Amanda Flores. LPA explained the reason of the inspection and a tour of the center was conducted both inside and outside. Director is requesting an increase of capacity from 32 infants to 40 infants. Facility will be caring for 16 crib infants and 24 non-crib infants. This program will operate year-round. This facility will provide full-time and part time options from 6:30 AM to 6:30 PM Monday through Friday. This program will operate in classrooms (Infant A, Infant B, Toddler A and Toddler B).

Director stated that the center will provide breakfast, lunch and snacks. The meals are prepared onsite. Parents will provide infant formula and diapers. Ill children will be isolated in the infirmary and/or in the directors office.

The classrooms were observed to be clean and free of toxins. LPA observed that the furniture and equipment appeared to be safe and in good condition. There are enough tables, chairs, cots, cribs and plenty of toys for children to play. Director stated that the facility will provide sheets for their child’s crib. Parents will provide sheets for the cots. LPA observed that each changing table is within arms reach of a sink. LPA also reminded Director not to store anything on top of high bookcases/storage cabinets that could potentially fall on children. There is a working carbon monoxide detector that is part of the facility’s smoke detector system and is installed throughout the building.

LPA reviewed with Director, that any future changes to the classrooms are required to ensure that furniture does not tip over on to children, the furniture are to be anchored or situated that tipping does not occur. Classroom changes of furniture shall be situated that 100% visual supervision is always provided to children in care. Director is aware the ratio is 1 Teacher to 4 infants and will follow the regulations. Construction of the facility was completed in 2022 and is not subject at this time to lead testing for drinking and cooking water.

Room measurements were taken and reviewed with Center Director. The total inside Infant area measured to an approximate 1,619 square feet which will only accommodate the requested capacity of 40 infant children at a time. There is adequate storage space available for children's belongings in the classroom. Center Director understands that children's equipment needs to match the capacity and age group center is licensed for. Toys and equipment appear to be age appropriate. Infant Room A and Infant Room B will serve children (0-12 months) who do not require use of toilet and/or potty toilet training. Applicant is not providing potty training to age group 0-12 months. Each infant classroom has a changing table and a sink within arm’s reach that will be available to children for handwashing if, needed. There is a total of 2 toilets and 6 sinks/hand washing fixtures which will accommodate the requested capacity of 40 infant.

The approximate outside square footage for the Infant area is 2,709 which will not accommodate requested capacity of 40 Infant Children. Director submitted outdoor waiver request with outdoor play schedule. The Infant play area is gated with alarms on gates. LPA observed age appropriate toys and a play structure that is appropriate for 6 months to 23 months. Staff will ensure children below the age of 6 months do not have access to structure when in the Infant play area. Structure includes landing no higher than 2 feet and applicant is using artificial turf to cushion fall zones. There is a large patio cover to provide shade where children can rest and get water.

A fire clearance of 174 children comprised of 40 infant children and 134 preschool children was denied by the Bakersfield Fire Department on 10/25/2023 due to preschool classrooms already being at max capacity. A new fire clearance will be requested.



This facility plans to provide Incidental Medical Services – IMS. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. A Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm The medication for the children will be kept in the classroom in an inaccessible locked cabinet.

Director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.
LPA also informed Director, of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The following will need to be corrected before licensure:

· New Fire Clearance

Pending a final file review a recommendation will be made to license the above facility for the requested capacity of 40 infant children.
