13 | On 11/16/22, Licensing Program Analyst (LPA) Gloria Reyes conducted an unannounced complaint visit to deliver findings of the complaint. The investigation consisted of interviews with the licensee, witnesses, observation and a review of facility records.
Interviews conducted with the licensee and the witnesses showed conflicting statements that when children are outside in the front that the gate may not always be closed. Licensee reported that the gate is closed when children are outside, and no child has ever run onto the street. One witness reported that the gate is open when outside and another witness reported that the gate is closed when outside. LPA reminded licensee that whenever children are outside, she must ensure that the gate is always closed, and she must provide supervision. Therefore, although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
