On July 30, 2024, Licensing Program Analyst’s (LPAs), Paul Garcia and Xona Xayavong conducted an unannounced Annual/Random inspection and was met by Licensee, Beatriz Bueno. Licensee is Spanish Speaking and English speaking. Days and hours of operation are Monday – Friday 4:40am – 6:00pm. The home has working telephone service and LPA confirmed the phone number is (661) 203-2437.

LPAs toured the home inside and outside and a census was taken. A current facility sketch was reviewed and Licensee confirmed that the dining room and living room bathroom and backyard are used for providing care and are accessible to all children. All other rooms are off-limits and made inaccessible by use of door locks. The outdoor play area in the backyard is fenced. There is one one (1) small dog, three (3) ducks, five (5) cats, five (5) chickens one (1) fecent on the property. Licensee understands the liability of pets around day care children and accepts responsibilities of any action taken by pets. During the inspection LPA’s observed an above-ground pool structure in the children’s accessible back yard. LPA's observed that the pool did have a cover however the cover did not meet the regulation of supporting the weight of an adult. LPA’s also observed that the ladder to the pool was not made inaccessible as it was approximately four (4) feet away which poses an immediate health, safety, or personal rights risk to persons in care.

Per licensee, there are no firearms or ammunition on the premises. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are made inaccessible.

The fireplace located in the off-limits living room and is made inaccessible and will not be in use during daycare hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There are no stairs in this home as this is a single level home. Many safe toys and play equipment are observed.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (B) Where an above-ground pool structure is used as the fence or where the fence is mounted on top of the pool structure, the pool shall be made inaccessible when not in use by removing or making the ladder inaccessible or erecting a barricade to prevent access to decking. If a barricade is used, the barricade shall meet the requirements of Section 102417(g)(5)(A).

Licensee also agrees to review 102417(g)(5)B or watch videos on found on the CCLD website “Bodies of Water” and write a one full handwritten page on what those regulations mean when it pertains to the health and safety for children in care. The handwritten report shall be received by the CCLD office no later than August 7, 2024.

Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.

LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D)

LPA Paul Garcia informed licensee Beatriz Bueno that this report dated July 30, 2024, documents one (1) of Type A citation. Type A citation which shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Paul Garciia informed the licensee Beatriz Bueno to provide a copy of this licensing report dated July 30, 2024, that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

This report shall be made available to the public upon request.

An exit interview was conducted, and this report was reviewed with the facility representative Beatriz Bueno.

A notice of site visit was issued and must remain posted for 30 days.

recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. Capacity as specified on the license is being maintained.

LPA reviewed a sample of children’s files and observed files were complete with emergency information as required. Licensee’s Mandated Reporter Training was completed on June 22, 2023. Licensee’s pediatric CPR/First Aid expires on May 20, 2025. A review of records indicates that all employees and/or volunteers have immunization records on file for influenza, pertussis and measles.

All adults who reside or work in the home have a criminal record clearance or exemption.

There are no excluded individuals present at this home. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) are not currently being provided. (Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee Beatriz Bueno was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee confirmed that there are no Registered Sex Offenders living in the facility.
