25 | On 08/19/2024 Licensing Program Analyst (LPA) Behatriz Gonzalez arrived at the facility to complete the investigation of an unusual incident report that was received on 4/12/2024. Present was Director Decondia Ferguson. Based on interviews and review it is determined that staff #1 forcefully restrained and held down Child #1 on multiple occasions, because he refused to take naps during quiet times. Staff # 1 used parts of her body as she hovered over the child causing the child to scream, kick, push, spit and bite due to the continuing use of the physical restraints. This is an immediate risk in that a 3-year old child experienced serious emotional trauma as a result of the intentional restraints inflicted by staff #1.
Exit interview conducted and report was reviewed with facility Representative Decondia Ferguson. Appeal rights were provided.
Per Title 22, Division 12, Chapter 3 of the California Code of Regulations, the following deficiency being cited: (see next page). No Civil Penalties were issued given that this is a Title 5 Program.
Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Director.
This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
