On 11/7/2023, Licensing Program Analyst (LPA) Ruby Ocegueda and Claribel Soto conducted an unannounced complaint inspection at the facility. LPAs met with Assistant Director Marisa Santos and Director Jessica Okamoto. The purpose of the inspection was to open a complaint inspection and investigate the above listed allegation. A tour of the facility was conducted and census was taken.

During the course of the investigation, LPAs Soto and Ocegueda collected facility records and conducted interviews of Reporting Party (RP) and staff. LPA’s also noted observations. Today, LPA’s interviewed multiple staff and discussed an incident in which a child (child #1) was injured on a play structure on 11/2/2023 at approximately 3:30 PM. Interviews revealed that outside in the play yard during the time of the incident was staff #1 with 17 children. Staff #1 was near the swings with another child, while child #1 was on the play structure, approximately 35 ft away. Staff #2 was inside and staff #3 was walking outside after the injury had already happened. There was no staff directly near the climbing play structure and staff #1 was turned away when the injury occured as she/he was tending to another child. Staff #1 could not tell LPA's how exactly child #1 injured him/herself today. Report continued to 9099-C

LPAs discussed the observations pertaining to the play yard in that it has multiple areas where it would be difficult for children to be adequately supervised without proper lines of vision from staff as there are multiple “blind spots”. Today, LPAs observed staff turning away from children who were on the opposite side of the play yard and other children in one corner unsupervised while playing roughly with each other and with toys.

LPA’s discussed visual supervision and the requirements to meet children’s needs for supervision while inside and outside. Director indicated that at this time there is no formal training on topics related to visual supervision or other licensing regulation requirements. Resources were provided to Director at her request.

This agency investigated the complaint allegation stated above and has determined that the complaint allegation was SUBSTANTIATED, meaning the preponderance of evidence standard has been met.

An exit interview was conducted with Center Director Jessica Okamoto.

Per California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiency was cited: (see 9099-D). Appeal Rights were provided today. LIC 9213 Notice of Site Visit was provided and will be posted for 30 days.

Director stated that she would provide all staff training on visual supervision. LPAs provided Director with online Department resources (ccld.ca.gov) where Director could use informational videos for training on visual supervision.

This requirement was not met as evidenced by: interviews. Interviews revealed that staff #1 was turned away tending to another child and was approximately 30-35 ft away from child #1 who was on the play structure when he/she obtained an injury. No staff was near the play structure supervising children.This poses a potential risk to the health, safety and personal rights risk to the children in care.
