On 11/20/2024, Licensing Program Analyst (LPA), Norma Lomeli met with Spanish-speaking Applicant, Deisy Argueta for a pre-licensing/change of location/ capacity increase inspection. Applicant and one minor children reside in the home. Background clearances are discussed and LIS 531 is signed indicating that the adults currently living in the home and/or providing care and supervision to children have a criminal record clearance. Fire clearance was granted on 10/4/2024.

Facility was inspected inside and outside as shown on the facility sketch and the following items were discussed:
  • Fire clearance was received on 10/4/2024. Fire pull alarm is located on the home’s dining room on the left wall.
  • This is a two story, three bedrooms and two bathrooms home and upstairs area will be off-limits to the day-care children. There is a gate at the bottom of the stairs that is not secured to the wall making upstairs area accessible. There is a bedroom downstairs that will be accessible to the day care children only when children need to use the accessible bathroom. There are three steps of stairs that lead into the bedroom to get to the bathroom. Applicant understands that she must have visual supervision of the children when coming down the steps. Off-limits rooms/ closets are made inaccessible by use of child proof door knob covers.Care and supervision will be provided in living room (day care room), dining room/kitchen and downstairs bathroom.
  • There is an electrical fireplace in the living room that applicant states it will be used during day-care hours. There is a secured wooden barricade making the fireplace inaccessible to the day care children. There is central air heating/cooling ventilation for safety and comfort.

  • LPA observed in the day care room, child size furniture, safe toys, and books for the children. There is a portable room air conditioner in the day care room. There is a flat screen television mounted onto the wall located above the fireplace mantle. There is a high chair in the dining room. Children will nap in the day care room on cots. Infants 12 months or older will nap in play yards. Applicant states she will only care for infants 12 months or older. Applicant understands she is to supervise children at all times. LPA provided applicant with Individual Sleeping Plan and Safe Sleep handout.
  • Facility has 3A40BC fire extinguisher mounted onto the kitchen wall. There is a functioning smoke alarm, carbon monoxide alarm and first aid kit in place.
  • Applicant’s Pediatric CPR and First Aid certification was completed through EMS Safety with Emergency Medical Services Authority stickers (EMSA) and expires on 4/20/2026. Applicant states her minor child who meets the age requirements to be an assistant will be her assistant. Applicant understands that her assistant cannot be left alone to provide care and supervision to the day care children
  • Preventative Health and Safety with Nutrition and Prevention of Lead exposure certification was completed on 8/28/2024.
  • Applicant completed the Mandated Reporter Training on 5/24/2024.
  • Knives are stored inside top kitchen cabinet. Medications are stored in an upstairs bedroom and in the inaccessible detached garage. Cleaning compounds are stored inside a top cabinet that in the inaccessible laundry room.
  • Advised applicant fire drills are to be conducted once every 6 months and must be documented with date and time.
  • Applicant is advised at least one staff member with current training in pediatric first aid and pediatric CPR is to be on site at all times children are present.
  • There are no bodies of water in the home or premises.
  • There are two dogs that are kept inside their separate kennels that are located in an accessible area in the backyard. There is a bird inside a cage that is kept in an upstairs bedroom. Applicant is advised it is her responsibility to ensure the safety of children in care at all times from the pets.

  • Applicant states there are no firearms or ammunition in the home or premises. Poisons are stored inside the key locked detached garage.
  • Applicant is reminded that any advertising (of day-care) such as business cards, flyers/posters, and/or signs must include facility number as per Title 22 Regulation "Advertisements and License Number" 102359 (a).
  • Applicant is advised that smoking is prohibited on the premises of a family child care home as specified in Health and Safety Code Section 1596.795(a). Applicant states the home is smoke-free.
  • Applicant states she will be transporting day care children. Applicant understands that she must have proper car restraints and/or car seats for all the children under her care when transporting children.
  • Fenced backyard has a cemented area for the children. There are safe toys for the children. There are two aluminum sheds one that applicant stores hardware tools, other keep out of reach of children items and is kept key locked. The other shed stores toys and child care materials.
  • LPA discussed safe sleep pending regulations and Safe Sleep Regulation Concepts were given to applicant.
  • Applicant is advised it is her responsibility to read and maintain her facility incompliance with Title 22 Regulations. Title 22 Regulations can be found at www.ccld.ca.gov.
  • SB 792 immunizations are on file.
  • Applicant is advised Fresno Community Care Licensing Department has inspection authority and can inspect all rooms in the home, garages and/or separate dwellings on the premises.
  • Incidental Medical Services (IMS) policy was discussed. Incidental Medical Services (IMS) are not currently being provided. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383.

Applicant is advised that she may access CCLD website at www.ccld.ca.gov for additional forms and licensing updates. Applicant is also reminded that it is her responsibility to read the regulations periodically.

Applicant states she will operate her day care Monday through Friday, 24 hours and as arranged. Overnight care will be provided. "Overnight Care" means care being provided to children anytime between the hours of 6:00 PM and 6:00 AM. Care provided during the day and overnight combined shall not exceed 24 hours from the time the child entered into care.

LPA & applicant discussed the Community Care Licensing website: LPA and applicant discussed new additions to the website that include the new PIN (Provider Information Notification) and information for providers including the Quarterly Update that informs licensees of new legislation and regulations. Please follow these steps go to http://www.cdss.ca.gov/, click on “information and resources” click “Community Care Licensing” Click “quarterly updates” click “Child Care advocates program” and register to PIN.

Applicant is advised the following items must be corrected and documentation be sent to Fresno CCL within the next 30 days to avoid possible withdraw.
  • Applicant will secure the child proof safety gate to make the upstairs area inaccessible to the day care children.
  • Applicant will provide LPA with Facility Sketch floor plans with room measurements and Facility Sketch for yard with measurements.
  • Applicant will make inaccessible metal rods, large pieces of wood board and wood posts that are located in the accessible backyard.

Pending verification of corrections of the above items and a final review of her application, licensure as a Large Family Day Care Home capacity of 14 children ages under 18 years will be recommended.
