On March 18, 2026, Licensing Program Analyst (LPA) Paul Garcia conducted an unannounced Case Management Incident inspection at the facility. Upon arrival, LPA met with Site Supervisor, Concepcion Carrillo. LPA Garcia toured the facility’s licensed areas and took a census of the children in care.

The purpose of this inspection was to follow up on an unusual incident reported to the Fresno Community Care Licensing Division (CCLD) on February 25, 2026. The report involved Child 1 (C1), who was found unsupervised inside a caterpillar tunnel sensory play structure located on the play yard.

After the visual inspection, LPA Garcia conducted interviews with witnesses and Site Supervisor, Concepcion Carrillo herself in order to gather additional information regarding the circumstances that led to the incident, supervision protocols, and any corrective actions taken. Observations by LPA Garcia took place to assess compliance with Title 22 regulations and to provide guidance pertaining to the continued safety and supervision of children in care.

Incident Summary

On Friday, February 23, 2026, at approximately 2:12 PM, during outdoor playground time, children were lining up to enter classroom G-2. A headcount was conducted, and all children, including C1, were accounted for. (See LIC809-C)

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Shortly after the headcount, the child ran from the line and hid inside a Caterpillar Tunnel located on the play yard. Staff did not realize the child was no longer with the group until they entered the classroom and closed the door. The child was immediately located inside the tunnel, which is within the gated perimeter of the outdoor play area. At no time did the child leave the premises.

Interviews

Interviews revealed that facility staff were outdoors supervising approximately 24 children with three staff members present, including a Site Supervisor who was alternating break coverage for her team. Interviews further indicated that staff initiated a physical headcount as children transitioned from outdoor play to the handwashing station inside the classroom. However, due to a distraction involving a child who required counseling, the headcount was interrupted and not completed. This lapse created an opportunity for C1 to leave the line undetected and enter the Caterpillar Tunnel, resulting in a significant breach of safety protocol.

Once the class entered the building and the door was closed, children were systematically transitioned to handwashing and toileting routines. During this process, S1 realized that C1 had not participated and immediately communicated with other staff to locate the child. When C1 was not found in the classroom, S1 looked out the classroom window and observed C1 inside the Caterpillar Tunnel. S1 promptly exited the classroom and ran toward C1, who appeared scared and emotional. The child was comforted and safely escorted back into the classroom.

This incedent resulted in a significant supervision concern and constituted a serious violation of regulatory standards.

Records Reviewed
  • Records reviewed indicated that at approximately 2:15 PM, C1 entered the Caterpillar Tunnel.
  • Records reviewed indicated that at 2:17 PM, C1 exited the Caterpillar Tunnel, then ran towards her classroom door then ran back towards the Caterpillar Tunnel.
  • Records reviewed indicated that at 2:23 PM, S1 exits the classroom, then escorts C1 back into the classroom.
  • Records reviewed, revealed that C1 was unsupervised for approximately eight minutes. (See LIC809-C)

Corrective Action

As a result of the supervision lapse, Site Supervisor Concepcion Carrillo conducted a staff meeting on February 26, 2026, with all classroom personnel present. The meeting addressed the following topics:

· Playground Supervision
· Active Supervision Procedures
· Professional Development Training

In addition to the training, the facility repositioned the Caterpillar Tunnel to improve visibility of children inside the structure from the classroom.

Staff were also instructed to implement a strengthened transition protocol, which includes initiating a physical count three times before and after each transition between indoor and outdoor movements.

Based on information gathered through documents, interviews and a complete review of the incident, it was determined that facility staff failed to ensure that (C1) was under the direct supervision of a teacher at all times.

The incomplete physical count and absence of supervision contributed to C1 successful opportunity to stray away from the line without detection resulting in a serious breach of safety.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiencies are cited: (see next page, 809 D)

LPA Paul Garcia informed Site Supervisor, Concepcion Carrillo that this report dated March 18, 2026, documents one Type A citation which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care. (See LIC809-C)

Also, LPA Paul Garcia informed the facility representative to provide a copy of this licensing report dated March 18, 2026, that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
  • An exit interview was conducted, and this report was reviewed with the facility representative Concepcion Carrillo .
  • Notice of site visit was issued and must remain posted for 30 days.
  • Appeal Rights were discussed and issued.
