32 | L1 denied the allegations and stated that children are included in all activities and given alternatives for treats and activities. Licensee also stated she tries to make a learning opportunity out of everything for the children. Licensee admitted that she made C1 write a letter and withheld a treat from C1 as a form of punishment for misbehaving during another child’s birthday celebration but that she provided an alternative snack to C1 and saved C1’s treat for the next day. L1 stated that the alleged inappropriate comment made to C1 was that C1 would not receive a treat on the date of the alleged incident due to misconduct.
During the investigation, interviews were conducted with staff (S1-S2), children, and parents on 06/29/22, 07/01/22, 07/11/22, 08/15/22, 08/17/22, and 09/01/22. Staff stated that the typical discipline approach at the facility is to implement a time out in which the Licensee would sit with the child and discuss the situation with the child. Staff stated that they would also redirect children from the situation and use positive reinforcement. Staff interviewed stated that they have not observed any forms of discipline used at the facility that would violate a child’s personal rights. Staff further stated that they have never spoken inappropriately to children or heard the Licensee make inappropriate comments to children in care.
Two children interviews corroborated that child C1 did not receive a treat on this day. Other children interviewed stated that they have not observed any inappropriate discipline being used on daycare children or heard staff speaking inappropriately to daycare children.
Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility’s licensee, Carrie Brown. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
