On July 19, 2024, at 2:15 p.m. Licensing Program Analyst (LPA) Ortega met with the Director, LPA disclosed the purpose of the inspection to deliver findings and was granted entry. Upon arrival, LPA observed 50 children in care and four staff providing care and supervision.
During the course of this investigation, LPA Ortega conducted confidential interviews, completed a classroom observation and reviewed documentation. During the interviews with Staff, and children no disclosures were made regrading concerns with the quality of care, and children did not show signs of concern. Interviews did not disclose the facility is in disrepair, staff yells at children in care,
nor staff inappropriately handles children in care.
The agency has investigated the complaint. It has been determined that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the above allegation is Unsubstantiated.
An exit interview was conducted, a copy of this report, and notice of site visit and appeal rights were provided to the facility center Director. Notice of site visit shall be posted for 30 days and the report shall be made available to the public for 3 years.

On 7/19/2024 Licensing Program Analyst(LPA)Isabel Ortega conducted a subsequent complaint inspection for the purpose of continuing to conduct interviews and deliver finding for above allegation. This investigation provided sufficient evidence: Day care children were not awarded privacy while utilizing the restroom, based on evidence obtained during the course of the investigation the allegation is deemed to be Substantiated. Ten out of fourteen interviews disclosed either they or someone walked in while utilizing the restroom therefore, no privacy was awarded. A finding of Substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. This facility was cited in accordance to Title 22 of the California Code of Regulations and/or Health & Safety codes under Personal Rights. Children were not provided with privacy while utilizing the restroom. Interviews disclosed children felt embarrassed and disclosed fear of the possibility of another student opening the door while utilizing the restroom due to experience of no privacy in the past. On 7/18/2024 LPA did not observe staff by the restroom door at all times while children individually utilized the restroom.
An exit interview conducted, appeal rights discussed, and a copy of this report was provided to licensee.

Facility will ensure privacy be granted to all children while utilizing the restroom at any time during day care hours of operation. Facility wil come up with a plan and place a poster sign on the restroom door "knock before opening the door" Facility will submit a picture of the sign posted to the Palmdale regional Office by 7/31/24 by email.

Based on interviews conducted and observation the facility did not ensure children have privacy while utilizing the restroom. Interviews disclosed children were embarrassed and have a fear of no privacy while utilizing the restroom. This poses a potential Health, Safety or Personal Rights risk to the persons in care.
