On 06/08/26, at 8:30 AM, Licensing Program Analyst (LPA) Anomeh Eivazian conducted an unannounced complaint inspection to the above facility to deliver above allegations’ findings. LPA met with Shonna Clark, director who guided analyst on a tour of the facility. During this inspection there were total of 27 children present at the facility playing in the yard with 5 staff.

During this investigation LPA conducted interviews with four staff, four children, and three parents. LPA obtained a copy of current facility roster.

Based on three parents’ interviews, no disclosures were made regarding above allegations.

Based on four children’s interviews, staff#1 yells and raises voice to the children, when children do not listen to staff#1 or do something wrong. Per four interviewed children, staff#1 asks children to cover their

ears when staff#1 yells or raises voice on a child(ren) who did something wrong. Per four interviewed children, it feels bad when staff#1 yells or raises voice.

Based on an interview that was conducted with staff#2, staff#1 raises her voice and yells at children when they do not listen to staff#1 or do something wrong. Per staff#2, staff#1 asks children to cover their ears when staff#1 yells at children. Per staff#2, there is no cameras in the classroom, but staff#1 tells children, if they do something wrong, staff#1 will check the cameras and they will get in trouble.

Based on an interview that was conducted with staff#1, staff#1 asks children to cover their ears, when staff#1 talks to a child(ren) who did not listen or did something wrong. Per staff#1, there is no cameras in the facility, but staff#1 said to the children, will check the cameras and if observe the child(ren) did something wrong, they will get in trouble.

Based on a picture that LPA obtained from complainant, it shows all the children in the classroom, while they were seated on the chairs in the classroom around the tables, they covered their both ears by their both hands, staff#1 is on the table and talking to a child who standing in front of staff#1.

Based on LPA’s evidence that she heard on the audio recording that was submitted by complainant, four interviewed staff confirmed in the recording was staff#1 who was talking to the children. On the recording staff#1 stated that will check the cameras, and if saw the child did threw it in trash will get in trouble. Staff#1’s was heard to talk to children loudly and pointed at the student.

Staff#1 was heard in recording to say:
Did you accidentally throw it?
A Child said: “ I do not know why”. (in a lower tone of voice).
Staff#1: I am not asking if it's yours. I'm asking if you accidentally threw it. Did you accidentally throw it? (staff#1 raised her voice).
Child#3, you saw him or you are just fibbing and your're gonna be in trouble too.
See what I mean? Mind your business.
If you did not see him, you do not say it was him. (staff#1 raised voice)
Child#4, did you see who threw it? Child#5, did you see who threw it? Child#6, did you see who took it?

Staff#1: Did you saw, you said you saw him. You saw him throw it?
A child said: Yeah
Staff#1: Did you do it? Look at me. Look at me. (staff#1 raised voice). Did you accidentally throw it? You did not mean to, but you did it.
You said he did not do it. Child#7 pick it up put in the trash.
If I look at the camera, child#3 and I see that you did do it, you are gonna be in trouble for fibbing. So, think about that.

Based on LPA observations, four staff and four children’s interviews, the preponderance of evidence standard has been meet, therefore the above allegations are found to be Substantiated at this time. Title 22 Regulation code 101223 (a) (1)--Personal Rights--(a)The licensee shall ensure that each child is accorded the following personal rights: (1)To be accorded dignity in his/her personal relationships with staff and other persons, and 101223(a)(3)--To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning are being cited on the attached LIC 9099D.

LPA Eivazian informed facility representative, Shonna Clark that this report dated (insert visit date) document(s) (number of Type A citation) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Eivazian informed the facility representative, Shonna Clark to provide a copy of this licensing report dated (insert visit date) that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

The Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days.

Per staff#1, it was a hot day this year, child#2 does not like to get naked, child#2 got wet, came to class to change, staff#1 asked child#2, why you took your clothes off, put your clothed back on. Per staff#1, went to get the child#2’s backpack from outside and gave child#2 the backpack. Staff#1 placed it on the floor, when staff#1 asked child#2, why you got naked, child#2 started crying, and asked child#2 to

change. Once child#2, got dressed still was crying and asked to step out the classroom to calm down, while staff#1 was by the door, and child#2 came back to the classroom.

Per staff#2, sometimes this year, they had water play, some of the kids got wet and when they got in the classroom, child#2 got fully undressed, staff#1 screaming at child#2, why you got undressed, no one can get naked in the classroom, staff#1 said you will be outside and naked, staff#1 brought child#2 inside and grabbed the backpack from outside and throw it toward the child#2, and child#2 got dress.

Per four interviewed children, no disclosures were made regarding child#2's allegation when got wet.

Allegation#3:
Based on staff#1 interview, child#1 was attending the school sometimes in 2023, and did not know child#1 feared dark. Per staff#1, children are under supervision all the time and never alone in the classroom or outside.

Based on staff#2 interview, staff#3 told staff#1 and staff#2 that child#1 feared dark. When other children were getting ready to take nap, the classroom lights were off and staff put a blanket on the door glass area, but still could see, and child#1 was waiting on the table to be picked up, and staff#2 stayed with child#1. Per staff#2, child#1 did not stay alone in the classroom when lights were off.

The allegations may have happened or are valid, but there are not a preponderance of evidence to prove the alleged violations occurred, therefore the allegations are unsubstantiated at this time. The evidence scale is equal meaning the weight of convincing evidence to prove something happened is equal to and has just as much convincing weight that it did not happen.

The Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days.
