32 | Allegation 1: the first allegation stated that unqualified staff was supervising preschoolers. During the investigation, it was revealed that staff are meeting the requirements to be a fully qualified teacher. LPA reviewed complaint documents and no discrepancies were found within the documents that staff do not meet the required education minimums under Title 22 Regulations. After reviewing all the relevant information obtained, there is not a preponderance of the evidence to support the allegation.
Allegation 2: the second allegation stated that staff are not adequately supervising preschoolers. During the investigation, it was revealed that staff are meeting the requirements of 100% care and supervision. LPA reviewed relevant complaint materials and no discrepancies were found that staff do not ensure 100% care and supervision of children while in care. After reviewing all the relevant information obtained, there is not a preponderance of the evidence to support the allegation.
Allegation 4: the fourth allegation stated that the Director was not present the required minimum time in the facility. During the investigation, it was revealed that the Director or other acting lead were present at the facility. LPA reviewed relevant complaint materials and no discrepancies were found that there was no Director or acting person present the minimum required time stated in Title 22 Regulations. After reviewing all the relevant information obtained, there is not a preponderance of the evidence to support the allegation.
After observations, record reviews, and interviews, it was determined that there was insufficient evidence that the facility was not ensuring staff were qualified to be teachers nor that there was not a Director present at the facility or other representative. The allegations could not be corroborated with the evidence found during the investigation. Therefore, the allegations have been found unsubstantiated. Although, the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the facility operated in violation of policy in this circumstance.
An exit interview was conducted, and a copy of this report was provided to Director along with the Notice of Site Visit and Appeal Rights.
