An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 6/27/2023 . A risk assessment was conducted appropriate PPE was used. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 04/06/2023. LPA met with Director, Janel Thrasher to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff and children. LPA also reviewed and obtained copies of the current children’s roster, photos, and other documentation.

Per the initial complaint report, the Reporting Party (RP) reported that Staff handled their child (child # 1) in a rough manner, by pulling the child’s jacket causing it to rip and that they witnessed the same staff covering their child’s mouth to keep the child quiet.

LPA interviewed child # 1 who stated that Staff # 1 pulled on their jacket “but it didn’t rip.

Regarding allegation: Staff handled the child in a rough manner: LPA conducted interviews with 3 Staff. Staff # 1 disclosed that in December 2022, child # 1 was clucking like a chicken- staff reminded child #1 that if they wanted to remain in their classroom they had to listen. Per staff # 1 since the child did not stop and since Child’s # 1 parents were not okay with them touching the child by the chin (to catch the child’s attention), staff # 1 bent down and “grabbed child #1 by the lapel of his jacket to catch his attention.” When Staff #1 disclosed this information, staff grabbed and tugged the right lapel (neck) of LPA’s jacket. Staff # 2 disclosed being aware of the jacket incident. Both Staff # 1 & 2 corroborated that jacket did not rip.

Regarding allegation: Staff used physical force to stop the child from speaking: LPA conducted interviews with 3 staff. Staff # 1 disclosed that Child #1 was sick and was getting picked up early, the exit door of their classroom is located by the napping area of the other classroom. Per Staff # 1 when Child # 1 saw their parent, the child screamed, and “it was a knee-jerk reaction, and I covered their mouth,” as they didn’t want the other children to wake up. Staff # 1 disclosed that parents witnessed the incident. Staff #2 and #3 corroborated that though they did not witness the incident they were aware of the incident happening.

This agency has investigated the complaint alleging staff handled child in a rough manner and staff used physical force to stop child from speaking. Based on LPA’s observations, interviews that were conducted, and records reviews, the preponderance of the evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with the facility representative, Janel Thrasher .

Per Director, they will have a staff meeting disscusing licensing visit and regulation violated and watch personal rights video on ccld.childcarevideos.org. Meetings minutes and signing sheet will be provided. Staff # 1 and # 2 will write a decleration on what they learned and their plan moving forward.

Regarding allegation: Staff spits on a child in care: LPA conducted interviews with 3 staff. Staff #1-3 corroborated that they have never spit on a child or witnessed any other staff spitting on children. Per Staff # 2, while in line Child # 1 spit on another child. Staff #2 took the children to Staff # 1. Per Staff # 1 they asked Child # 2 if Child # 1 had spat on them or blown a raspberry. Child # 2 then turned around to Child # 1 and responded, “he did this” and blew a raspberry on Child # 1. Per staff # 2 they were no longer in that area to witness this interaction. LPA interviewed Child # 2 who stated that they've never been spit on by a teacher or another child.

Additionally, LPA interviewed parents who corroborated that they did not have any concern with the care provided to their children.

This agency has investigated the complaint alleging staff spit on child in care. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
