32 | LPA interviewed child # 1 who stated that Staff # 1 pulled on their jacket “but it didn’t rip.
Regarding allegation: Staff handled the child in a rough manner: LPA conducted interviews with 3 Staff. Staff # 1 disclosed that in December 2022, child # 1 was clucking like a chicken- staff reminded child #1 that if they wanted to remain in their classroom they had to listen. Per staff # 1 since the child did not stop and since Child’s # 1 parents were not okay with them touching the child by the chin (to catch the child’s attention), staff # 1 bent down and “grabbed child #1 by the lapel of his jacket to catch his attention.” When Staff #1 disclosed this information, staff grabbed and tugged the right lapel (neck) of LPA’s jacket. Staff # 2 disclosed being aware of the jacket incident. Both Staff # 1 & 2 corroborated that jacket did not rip.
Regarding allegation: Staff used physical force to stop the child from speaking: LPA conducted interviews with 3 staff. Staff # 1 disclosed that Child #1 was sick and was getting picked up early, the exit door of their classroom is located by the napping area of the other classroom. Per Staff # 1 when Child # 1 saw their parent, the child screamed, and “it was a knee-jerk reaction, and I covered their mouth,” as they didn’t want the other children to wake up. Staff # 1 disclosed that parents witnessed the incident. Staff #2 and #3 corroborated that though they did not witness the incident they were aware of the incident happening.
This agency has investigated the complaint alleging staff handled child in a rough manner and staff used physical force to stop child from speaking. Based on LPA’s observations, interviews that were conducted, and records reviews, the preponderance of the evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
