32 | Pertaining to the allegations “Licensee is not preventing a day care child from posing a health risk to other day care children while in care” and “Licensee is not preventing a day care child from posing a safety risk to other day care children while in care.”
Per reporting party, there is a child in the class that spits and throws objects at other children, kicks and crawls under the table to try to make the table fall over, and nothing is being done to protect the health and safety of the children and staff. Every day the child engages in this behavior, and the staff is told to just give the child what they want.
Per staff and LPA observation C1 exhibits significant behavioral challenges including flipping tables, throwing toys, spitting on staff and children, running, and climbing on or under furniture. C1 has difficulty with transitions, frequently resisting movement between activities, especially when coming in from outdoor play or stopping preferred tasks. C1’s meltdowns during transitions may include screaming, crying, fighting, throwing items, or refusing to clean up.
Per Staff #2 (S2), when issues arise, teachers are required to document incidents on the Daily communication cards. The center uses this information to speak to the parents. S2 stated they would discuss C1’s daily activity at pick up, and conducted multiple meetings with parents starting on 1/15/26, 1/22/26, 3/11/26, 3/20/26, 3/24/26, 4/9/26, 4/27/26. 5/7/26, 5/13/26 and 5/27/26. At each meeting they would talk about health and behavioral plans. The parents agreed to try and keep the same consistent routines at home.
All parents interviewed had no concerns regarding the facility.
Based upon evidence obtained during this investigation, the allegations “Licensee is not preventing a day care child from posing a health risk to other day care children while in care” and “Licensee is not preventing a day care child from posing a safety risk to other day care children while in care”, have been determined to be unsubstantiated. Although that a complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred.
Exit interview conducted and report was reviewed with Director Lena Blakeney. Notice of site visit was given and must remain posted for 30 days.
