On 03/17/2023, at 11:00 AM, Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. LPA met with facility Director, Kori Vartanian during the visit. Also present in the facility were 36 day care children and 5 teachers/staff. Facility was within ratio & capacity. A COVID 19 risk assessment was conducted upon entry and appropriate PPE was used by LPA.

Analyst reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.

Facility provided facility sketch and required forms LIC 9276, LIC999 and LIC9275 to LPA on 11/17/22 and 3/3/23. On 11/4/2022 and 12/28/22 and 2/17/23, the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 10/28/22, 12/16/22, and 2/10/23. Faucets and drinking fountain reported with 5.5 ppb or greater lead exceedance levels were as follows:
· B – Bubbler in Bewley Room (6.850 UG/L) – Faucet currently not in use as room is not being utilized due to low enrollment

Director stated that prior to the discovery of its lead level exceedance, the facility has not been using the bubbler as the room has not been utilitzed due to low enrollment. The bubbler’s use was terminated when the facility was informed that it was exceeding acceptable levels.

· Bubbler has been replaced, retested with a sample date of 2/10/23, and testing results indicate lead level is less than 1.000 UG/L, which is within the allowable limits.

Exit interview conducted and report was reviewed with Director, Kori Vartanian. A copy of PIN 21-21-CCP and appeal rights were provided to facility today. A notice of site visit was also provided and must remain posted for 30 days.
