Licensing Program Analyst (LPA) Ulysses Coronel initiated a complaint investigation for the allegation listed above. LPA met with Aaron Khodorkhovsky, the facility administrator and the purpose of the visit was explained.

The investigation consisted of the following: During today’s visit LPA and administraror conducted a tour of the facility, which includes client bedrooms, restroom, kitchen, dining room and outside smoking areas. LPA interviewed the administrator, 4 staff and 10 out of 83 clients. LPA reviewed client and facility records.

The Investigation revealed the following: Regarding the allegation: "Staff not providing residents with a comfortable environment." During todays visit LPA did not observe loud music with explicit content being played inside or outside of the facility. During todays visit the administrator stated that "I did approach client C2 to lower their music and even offerred them headphones so they can listen to their music. C2 was cooperative and lowered the music, all it really takes is to ask the client and most clients will comply.

During todays visit 4 out of 4 staff interviewed did not have any concerns regarding loud music with explicit content being played at the facility, staff S1 stated "Some clients do like to have their music loud in the mornings but all of them cooperate when I request them to lower the volume. Most of the music I hear is old school music and nothing explicit." Staff S3 stated, "Clients do play music from their cellphones, the music will sound loud when your near but its barely noticeable from a distance and since most of them use Youtube to play music, all the explicit contents are already filtered out." During todays visit, 9 out of 10 clients interviewed did not have any complaints regarding loud music with explicit content being played at the facility, Client C2 stated "I like playing R&B music, but it does not have explicit content and I don’t really play my music that loud." Client C5 stated "Some people like rap music, some like rock, some like country but never too loud or so explicit that it becomes annoying. Regarding the allegation; “Staff not providing residents with a comfortable environment.” although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

No deficiencies were cited. An exit interview was conducted, and a copy of this report was provided.
