Licensing Program Analyst (LPA) Bennette Pena conducted a subsequent complaint visit for the allegations listed above. LPA met with Craig Pardue, Administrator and explained the purpose of the visit. Shortly after, Danelle Loboda, Co-administator arrived to provide additional assistance to LPA.

The investigation consisted of the following: On 03/21/2025, LPA conducted a tour of facility and common areas and requested copies of Client and Staff Rosters, Client #1 (C1) files such as Identification and Emergency Information Sheet, Admission Agreement, Physician's Report, Preplacement Appraisal and latest IPP.
During today's visit, LPA obtained copies of client & staff rosters, staff in-service training regarding abuse, clients rights, mandated reporting and zero tolerance policy, Staff #3 (S3)'s files/training records and C1's doctor notes/summary (03/17/2025). LPA interviewed Staff #1 (S1)-Staff #5 (S5) , Client #2 (C2) - Client #5 (C5) and telephonically interviewed SGPRC Service Coordinator (SC). LPA also attempted to interview Client #1 (C1), but unsuccessful due to C1 was at her work site.*****CONTINUED ON LIC9099-C*****

The investigation revealed the following:

In regards to the allegation: “Facility staff are now allowing client access to different areas of the home.” It is alleged that a staff did not allow C1 to go to work and was told to stay in her room. (5) out of (5) staff interviewed denied the allegation. Staff members indicated that clients are free to do what they want and they can go in and out of the facility whenever they want as this is their home. Staff interviewed stated that they receive in service training regarding clients' rights, abuse and zero tolerance policy on a regular basis. (3) out of (5) staff interviewed stated that C1 complained about a foot injury and was examined by a physician on 03/17/2025, who recommended C1 to stay home for 2 days to prevent further injury. All staff interviewed also stated that no one has told clients to stay in their room and not to go out for no reason as that will be a violation of the clients' rights. Interview with SC revealed that San Gabriel Pomona Regional Center has investigated this allegation on 03/20/2025 and found no issues to be concerned about. (4) out of (5) clients interviewed denied the allegation and indicated that staff allow them to do what they want in the facility and can come and go at their convenience. Based on record reviews, no staff members in the facility faced disciplinary measures for violating clients' rights. Interviewed clients also stated that they consider the facility their home and feel safe. Therefore, there was insufficient evidence to corroborate with this allegation.

In regards to the allegation: “Facility staff do not treat client with dignity and respect.” It is alleged that a staff was yelling at C1, making C1 stay in her room for 2 days and C1 cannot come out for any reason. (5) out of (5) staff interviewed denied the allegation and stated that they treat all clients with respect and never yelled at anyone. Staff interviewed stated that they receive in service training regarding clients' rights, abuse and zero tolerance policy on a regular basis. All staff interviewed also stated that no one has told the clients to stay in their room and not come out for any reason. Interview with SC revealed that San Gabriel Pomona Regional Center has investigated this allegation on 03/20/2025 and found no issues to be concerned about. (4) out of (5) clients interviewed denied the allegation and indicated that staff interact and treat them with dignity and respect. Interviewed clients also stated that none of the staff have ever made them do anything against their will nor yelled at them. During the visit, LPA observed staff speaking with clients respectfully and not being loud or speaking in loud voices. Therefore, there was insufficient evidence to corroborate with this allegation.

Based on statements and interviews conducted with staff, clients, review of facility file records, there was not enough supportive evidence to concur with the reported allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
