32 | Regarding the allegation: Outdoor equipment is unsafe for children in care. RP alleged that a metal gate separating the outdoor play yard and a ledge is unstable. LPA toured the outdoor play yard and observed a metal fence which is located on the preschool side of the facility. LPA tested test the stability of the fence and found it to be unstable and wobbly. LPA deemed the unstable fence to be a health and safety risk for the children and advised the facility to immediately block off the fence and conduct repairs.
Based on LPA’s observation, the preponderance of the evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, Article 07, 101238.2(g)(1) is being cited on the attached LIC9099D.
An exit Interview was conducted, a copy of this report and appeal rights along with Notice of Site visit was provided to Janet Diaz. Notice of Site visit must be posted for 30 days.
