On March 4, 2025, Licensing Program Analysts (LPAs) Staicy Perry and Joanne Solorio Campos conducted an unannounced complaint investigation for the above allegation to deliver findings. LPA’s met with director Marcia P. Cagigas who guided LPA on a tour of the facility. LPAs observed a total of 72 children in care.

During the investigation, LPAs interviewed Staff #1 (S1) through Staff #4 (S4), 10 parents and 4 children interviews conducted. Also obtained was current facility roster, sign in and out sheets, parent handbook, staff time sheet, and reviewed surveillance video footage of the incident with the East Los Angeles Community College Sheriff’s Department. Attempts were made to interview the Reporting Party (RP) and were unsuccessful.

Allegation: Staff inappropriately restrained a daycare child while in care.

According to the Reporting Party (RP), “the mother dropped by the school early to pick up her child.

When she walked-in, RP reports she observed a male teacher restraining the child on the mat where the child takes a nap. RP reports the mother indicated that the teacher appeared to be putting all his weight
on top of the child. Moreover, RP reports the child kept whining and telling the teacher to stop.” RP also stated the mother also addressed her concerns with the director. RP reports the director ensured the mother that matter would be addressed with the teacher.

During interviews conducted with staff, S#1 stated that S#3 was observed sitting on the floor near C#1’s mat trying to nap C#1 as usual and did not observe S#3 restraining C#1. S#1 stated that C#1 did say something when C#1’s parent walked in but was unsure of what C#1 said. S#2 stated that they witnessed S#3 laying C#1 down on their mat and S#3’s arms were positioned in a bridge like manner over the mat and C#1, this way C#1 can stay on their mat and rest. S#2 also stated that S#3 was trying to soothe C#1 and have C#1 rest. S#2 stated that they did not observe S#3 restraining C#1 nor have physical weight on C#1. S#2 stated that it was hard to understand if C#1 was saying “stop” due to him being nonverbal in class. S#3 did disclose that they were positioned on the floor with their arm in a bridge like manner over the mat and C#1 to calm C#1 down to rest and to not let C#1 get up. S#3 stated that they were trying to soothe and relax C#1. S#3 stated they were not restraining the child nor have physical weight on C#1. S#3 stated that it’s very hard to communicate and understand what C#1 was saying. Staff stated that they did observe when parent of C#1 walked into the classroom and parent immediately stated that C#1 was saying, “stop it”. S#4 stated that S#3 was not observed to be restraining C#1. S#4 stated that S#3 was positioned on the floor resting on their side hip and elbow with S#3’s arm over the mat and C#1 and was trying to help C#1 rest, like a bridge over C#1 and the mat. All staff corroborated that S#3 did have arm over mat and C#1. Per s#4, C#1 is working with the Regional Center for assistance and has 2 current therapist that come to the facility during the week.

During LPA’s review of surveillance video footage of the incident, LPA Perry observed S#3 positioned on the floor side by side to the mat and C#1, with S#3’s arm to be in a bridge-like manner over the mat and C#1. LPA did not observe C#1 to be restrained by S#3’s weight. LPA Perry observed S#3 in the video to be guiding C#1 back to the mat but not observed to be with force. LPA observed when S#4 and parent of C#1 entered the room. They calmly approached the area where C#1 was lying in his mat and LPA Perry observed C#1 then get up and move into parents’ arms, then starts to visibly cry. Following the interaction, the parent of C#1 and S#4 were observed to be talking then exit the classroom with C#1. Video footage is blurry and very glitchy. Video has no sound and was unable to hear any voice. LPA did observe that S#3 did have arm over mat and C#1.

Parent interviews made no disclosures pertaining to the above allegations. All parents disclosed that they have no issues with the facility and that their children love attending the facility. All parents stated that they have no issues with the care and supervision of their children. No disclosures were made during children’s interviews. LPAs observations during the investigation, facility was in ratio at all times, LPA did not see teachers restraining children nor did LPA Perry observe any personal rights violation being violated during inspections.

Concluding the investigation, S#4 disclosed that C#1 has returned to the facility. Currently, C#1 has taken a liking to a staff member who is aiding C#1’s needs.

Based on interviews and disclosures made during the department investigation, the preponderance of evidence and the standard has been met, therefore, the allegation is found to be substantiated. California Code of Regulations (Title 22 Division & Chapter), are being cited on the attached deficiencies page LIC 9099-D. These incidents pose a potential risk to the Health and Safety of the children in care.

A notice of site visit was given and must remain posted for 30 days. Appeal Rights provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights were given and explained. Exit interview conducted, report provided to Director Marcia P. Cagigas.

Director stated they have a training and Director will go over children's personal rights. Director will email a copy of the training agenda and sign in and out sheets of staff attendace to LPA Perry after the training is completed via email by POC date.

This requirement was not met as evidenced by: Based on interviews, the licensee did not comply with the section cited above in S#3 had arm over mat and C#1 during naptime to refrain C#1 from getting up, which poses/posed a potential health, safety or personal rights risk to persons in care.
