An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 7/24/2026. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 6/24/26. LPA met with Facility Representative Maria Higareda to whom the purpose of the inspection was announced. Census was taken- Per facility representative there are 86 children enrolled.

Throughout the course of the investigation, interviews were conducted with staff and parents. LPA also reviewed and obtained copies of children’s rosters, personnel report and other documentation.

Per initial complaint report, the complainant reported that (1) Staff do not provide adequate supervision to daycare children as Staff # 1 often falls asleep when supervising nap time and children have been observed to be left unsupervised in the restroom- when staff # 1 is supposed to be supervising. (2) Staff are arguing in the presence of daycare children as Staff # 1 creates conflicts in the classroom with other staff in front of children. In regard to allegation (1) Staff do not provide adequate supervision to daycare children. Staff # 1-11 corroborated that during children’s nap time staff is to actively supervise children sleeping and make sure that they are safe. Staff # 1-11 corroborated that staff is not allowed to sleep during children’s nap time as they are supposed to be supervising the children.

7 out of 11 staff corroborated that they have observed staff # 1 fall asleep in the classroom for seconds and or intervals of 5 minutes during children’s nap time. During interview staff # 1 disclosed that they have fallen asleep in the classroom “maybe 10 minutes or so,” per staff # 1 they have also observed another staff member sleeping in the class. Staff disclosed that there has been times that staff # 1 falls asleep with their cell phone in their hand and the phone falls off their hands waking children up.

Staff interviews corroborated that they have never observed a child left unattended in the restroom as a staff member is always present in the restroom.

Regarding allegation # 2 staff are arguing in the presence of children. Staff interviews were conducted. 6 out 11 staff interviews corroborated that they have observed arguments in front of children. 3 out 11 staff corroborated that they have witnessed staff # 1 argue with staff # 2 in front of children. Staff # 1 and # 7 admitted that they have argued in front of children with Staff # 2.

Regarding allegation # 1 & # 2: 2 out 11 staff corroborated that they are aware that administration is aware of staff # 1 falling asleep in the classroom and of arguments happening in front of children- but the issue has not been addressed. Per Staff # 11- they were notified of staff # 1 sleeping in the classroom but they have not personally witnessed it when observing the classrooms.

LPA attempted interview with child # 1- no disclosures made.

LPA conducted interviews with parents. Parent interviews corroborated that they have not observed any inappropriate interactions between staff.

This agency has investigated the complaint alleging Staff do not provide adequate supervision to daycare children and Staff are arguing in the presence of daycare children. Based on LPA’s observations and interviews which were conducted and record reviews, the preponderance of the evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED.

Staff # 1 falling asleep in the classroom is not providing active supervision to children and unable to respond to a child’s need if they are sleeping. Additionally, staff arguing in front of children is a violating of the children’s personal rights- as they should be accorded dignity in their relationship with staff .

California Code of Regulations, (Title 22, Division 12 & Chapter 3 (FCC) (1 DCC) number) are being cited on the attached LIC 9099D.

A notice of site visit was given and must remain posted for 30 days.
Exit interview conducted and report was reviewed with Facility Representative Maria Higadera.
