Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced complaint inspection to deliver findings for the above allegation. LPA met with School Age Director, Nicole Islas to whom the reason for the visit was explained. Teacher, Neledy Galvez guided LPA on a tour of the facility. Director, Adriana Allen arrived at approximately 15 minutes later. LPA observed eight (8) children and two (2) staff were present at the facility during this inspection.

During this investigation, LPA conducted interviews with five (5) staff, nine (9) day care children, and six (6) day care parents. LPA Babcock also obtained documents related to the complaint allegation, including but not limited to, a copy of the Facility Roster (LIC 9040), and Personnel Report (LIC 500).

Allegation: Staff yelled at a child in care.

According to the allegation, a teacher, Staff #5 was observed yelling at a child in care. During interviews, five of nine children interviewed stated they have heard a teacher yelling at a child in care. Child #3 and child #5 stated, teachers yell at children when “the kids are not listening”. Child #7 stated teachers yell, “Go to sleep” at children in care. When asked which teachers yell at children, Child #3 and Child #5 replied with the name of Staff #5. Child #7 stated it makes them "sad" when the teacher yells and "they do it loud".

Based on interviews conducted by LPA Babcock, the preponderance of evidence
standard has been met, therefore the above allegation is found to be
SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & chapter 1), are
being cited on the attached LIC 9099D.

A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of
$100.

An exit interview conducted, and the report was reviewed with Director, Adriana Allen.

Director states she will meet with all staff individually to discuss children's personal rights, and steps to take if they become frustrated in the workplace. Director will email LPA the meeting agenda signed by all staff.

This requirement was not met as evidenced by: 5 of 9 children interviewed stated the teachers have yelled at children in care. This poses a potential health and safety risk to the children in care.
