Licensing Program Analysts (LPAs) Cynthia Reyes and Mariah Aguirre conducted an unannounced site inspection to present the findings of the above complaint allegations. This inspection is to ensure the health and safety standards as required by the regulations governing child care centers are met. LPAs met with Diana Rodriguez, Office Manager and new Director, Monique Smith arrived shortly after. LPAs went on a tour of the facility indoors and out.

During the course of this investigation, LPAs conducted Interviews, received and reviewed documents, obtained declarations and LPAs own observations.

Neglect/Lack of Supervision: Per reporting party, Staff are not providing adequate supervision to children in care. Staff did not prevent day-care child from wandering out of the facility. LPAs Substantiated and cited this allegation on a co-complaint (33-CC-20240829133316) dated 10/03/2024. No citation will be given on this complaint as the allegation was already cited.

During the course of this investigation, LPAs conducted Interviews, and received and reviewed documents.

Personal Rights-Per Reporting Party, Staff are not meeting child's diapering needs. RP stated that the school would tell her, that her child would have a rash from home, but her child never had a rash at home, her child would have a rash at pick up time from the school. Per interviews with staff it was stated that the child is with the social worker and paternal mom when a rash is notice on the child and is not from when the child is at the school.

Based on interviews, declarations, records reviewed and received and LPAs own observations, the above allegations are deemed UNSUBSTANTIATED. Although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

An exit interview was conducted, and a copy of this report was provided to Monique Smith, Director, along with the Notice of Site Visit and Appeal Rights.

License- Staff commingle children in care. Per reporting party, staff commingle school age children in the preschool classroom on a daily basis. Interviews conducted, LPAs own observations and documents reviewed and received, determined that the preschool children and school age children are commingled mostly during the early morning hours and at the end of the day.

The following deficiency(s) listed on the attached LIC 9099D (deficiency page) is being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safe.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Consultation was conducted on this date

Exit interview conducted and report was reviewed with Monique Smith, Director.

LPA Reyes informed Director, Monique Smith that this report dated 10/22/2024 document(s) (1) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Reyes informed the Director, Monique Smith to provide a copy of this licensing report dated 10/22/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A copy of the LIC 9224 was provided to the director on this date.
