Licensing Program Analysts (LPAs) Cynthia Reyes and Kamile Martin conducted an unannounced site inspection to present the findings of the above complaint allegation. This inspection is to ensure the health and safety standards as required by the regulations governing child care centers are met. LPA met with Diana Rodriguez Office Manager, and new Director, Viviana Alvarez arrived shortly after. LPAs were taken on a tour of the facility indoors and out.

During the course of this investigation, LPAs conducted Interviews, and reviewed and received records and declarations.

Personal Rights- Per reporting party, Staff are engaging in verbal arguments in front of the children. Per interviews with staff and children, it was stated that the administrator had verbal confrontations with a couple staff members in front of children, due to disagreements they had with each other during both arguments.

Personal Rights- Per reporting party, Staff yelling at the children. Per interviews with other staff it was stated that staff #1 is loud and rude to the children. Staff also stated that staff #1 lifts her hand as if she is going to hit the child for not listening, but she does not hit them. Per interviews with children it was stated that staff #1 does yell at them and is loud and some times seams mean.

Based on LPAs observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, are being cited on the attached LIC 9099D page. Deficiencies that are being cited need to be cleared to protect the children’s health & safe.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100

Exit interview conducted and report was reviewed with the Viviana Alvarez, Director.

LPA Reyes informed Director, Viviana Alvarez that this report dated 01/29/2025 document(s) (1) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Reyes informed the Director, Viviana Alvarez to provide a copy of this licensing report dated 01/29/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A copy of the LIC 9224 was provided to the director on this date.

Director states they will have a training regarding children personal rights and communication with children by the POC date of 02/14/2025. Director will email a copy of the training agenda, what was learned and staff sign in sheet to the LPA after the training is completed.

some times smells of marijuana when they are in the car together and the smell could have rubbed off on her clothing during that time.

Food Service- Per reporting party, Staff does not practice proper sanitation procedures when preparing food. RP stated another previous staff member had witnessed staff #1 making food in the kitchen and taste the food with the spoon that she was using and continued using the same spoon to continue cooking. Per interviews it was stated that no one has seen staff #1 cook and are not able to say if that has happened or not. Staff #1 stated that she has never done that. Staff #1 stated that she would taste the food and throw the spoon in the sink to be cleaned and get a new spoon to stir the food.

Neglect/Lack of Supervision- Per reporting party, Child was left unattended. RP stated she witness a staff member leave a child behind while transitioning the kids to another class. The little girl was playing in the closet of the 4/5 class room. Per interviews there were no disclosures of any witnesses to this incident occurring and the staff member that was stated had eft the child denied that the incident happened.

Personal Rights- Staff swatted a girl’s hand for not listening. RP stated that a previous staff member saw staff #1 swat a little girl’s hand for not listening. Per interviews there were no disclosures of anyone witnessing staff #1 swat a child on the hand.

Based on interviews, declarations, records reviewed and received and LPAs own observations, the above allegations are deemed UNSUBSTANTIATED. Although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

An exit interview was conducted, and a copy of this report was provided to Viviana Alvarez, Director, along with the Notice of Site Visit and Appeal Rights
