Licensing Program Analyst (LPA) Cynthia Reyes conducted a Case Management Deficiencies inspection on this date to address deficiencies revealed during a previous inspection on 04/11/2024. Upon entry LPA observed the Director Arleen and Aid/Van driver Elizabeth with 4 children in care. Later during this inspection staff member Diana, book keeper arrived and assisted the LPA with documents needed. In the afternoon, Owner Uma Chander and Administrator Raj Chander arrived.

LPA informed Arleen and Uma why this inspection was being conducted on this date and that a report and citation will be documented for both the preschool and the school age. The following deficiencies with reason for them are listed below.

Criminal Record Clearance 101170(e)(1)(2) LPA observed during file review and staff names and census taken, that staff # 4 is not fingerprint cleared and staff # 1 is not fingerprint associated to this facility. LPA made a telephone call to the MPRO office and verified with the department guardian and LIS system. Citation and civil penalty is being assessed.

HSC 1597.16(a)(1) (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. Based on interviews conducted the owner states no lead testing has been conducted.

LPA observed a therapist arrived at the day care about 3PM and was alone with a child. The facility did not have proof of who the therapist is documented in the child file or in the facility.

Indoor Activity Space for School Age Children- 101538.3 (b) In combination programs, indoor activity space provided for school-age child care center children shall be physically separated from space provided for infant care and child care center children. Per interviews it was stated that preschool and school age children are commingled in the morning and in the afternoon due to staffing issues. During interviews it was stated to LPA that a van driver/aid opens the day care in the morning at 6 AM and is left alone with preschool and school age children and are commingled until the new Director arrives about 715 AM. It was also stated that in the afternoon when the new Director leaves about 330 PM, an aid or van driver is left alone with either the preschool or school age children in their own class room and then commingled toward the end of the day. The facility school age license is F# 191594874.

Teacher Aide Qualifications and Duties- 101216.2 (e) An aide shall work only under the direct supervision of a teacher. Staff #3 is an aid/van driver and only has 3 units of schooling and has been left alone with no teacher or other staff member in the facility, every morning for over a month as she opens the day care preschool and school age program.

Reporting Requirements 101212 (d) Per interviews it was stated that no one from the facility called or faxed in a incident report that occurred on 04/4/2024. Per interviews the owner Uma stated she called the incident in on 04/10/2024 and the person (no name was documented) on the phone told her to fax the report in and she did that the same day. Uma stated they did not report it right away due to they did not think there was a problem.

Based on Interviews, LPA observations and records received and reviewed, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

LPA Cynthia Reyes informed owner Uma and Director Arleen that this report dated 04/12/2024 documents 4 Type A citations. Type A citations which shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care.

LPA Cynthia Reyes informed the owner Uma and Director Arleen to provide a copy of this licensing report dated 04/12/2024 that documents 4 Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.



The Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
