Licensing Program Analyst (LPA) Mireya Garcia conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. LPA was greeted by Office Manger, Cindy Duffin who provided LPA with visitor pass. LPA then met with Lead Teacher, Leona Sie who guided LPA on a tour of the facility indoors. During the tour Director, Sofia Valdez arrived and continued the tour in the outdoors. Census was taken.

During the inspection LPA reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility representative during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. Facility provided facility sketch and required forms LIC 9276 and LIC9275 to LPA.

During this inspection, facility provided LPA Garcia copies of the facility sketch, LIC 9276, LIC 9275, and water analysis results from sample dates 07/27/22 & 10/27/22.

On 08/03/2022, the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 07/27/2022. Faucets and drinking fountain reported with 5.5 ppb or greater lead exceedance levels were as follows:
  • "LWA-D Pre-school Building Room 4, Sink 1" - A sink faucet located inside the classroom #4 tested with a result of (7.19 ug/L) – This sink faucet is used for hand washing only. The proof was verified in person during this inspection and pictures were taken.

In records review of test results report dated 08/17/2022, LPA Garcia observed that an additional sink faucet located in the same sink in Room #4, also tested with 5.5 ppb or greater lead exceedance levels were as follows:
  • "LWA-E Pre-school Building Room 4, Sink 2" - A sink faucet located inside the classroom #4 tested with a result of (10.06 ug/L) – This sink faucet is used for hand washing only. The proof was verified in person during this inspection and pictures were taken.


Since the sink faucets are not being used for consumption or food preparation and the sink faucets were replaced and retested and results are within regulatory limit, therefore, no deficiencies were cited during this inspection.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.
