Licensing Program Analysts (LPAs) Cynthia Reyes and Kamile Martin conducted an unannounced site inspection to present the findings of the above complaint allegation. This inspection is to ensure the health and safety standards as required by the regulations governing child care centers are met. LPA met with Diania Rodriguez Office Manager, and new Director, Viviana Alvarez arrived shortly after. LPAs were taken on a tour of the facility indoors and out.

During the course of this investigation, LPAs conducted Interviews, and reviewed and received records.

Personal Rights- Per reporting party, Staff raised her voice and makes the child feel belittled and bullied. RP stated that staff #1 is old school and is loud and her child would try to make staff #1 happy but he is autistic and maybe staff #1 could not handle him. Per interviews with other staff it was stated that staff #1 is loud and rude to the children. Staff also stated that staff #1 lifts her hand as if she is going to hit the child for not listenig, but she does not hit them. Per interviews with children it was stated that staff #1 does yell at them.

Staff #1 stated that the directors and owners did speak with her regarding her being loud and or yelling. However no training was ever given regarding personal rights or communication with children. Staff #1 denied yelling at any child but did state she has a loud voice and has been told she has a loud voice with the children.

Based on LPAs observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, are being cited on the attached LIC 9099D page. Deficiencies that are being cited need to be cleared to protect the children’s health & safe.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100

Exit interview conducted and report was reviewed with the Viviana Alvarez, Director.

LPA Reyes informed Director, Viviana Alvarez that this report dated 01/29/2025 document(s) (1) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Reyes informed the Director, Viviana Alvarez to provide a copy of this licensing report dated 01/29/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A copy of the LIC 9224 was provided to the director on this date.

Director states they will have a training regarding children personal right sand communication with children by the POC date of 02/14/2025. Director will email a copy of the training agenda and staff sign in sheet to the LPA after the training is completed.
