On 04/2/2025 Licensing Program Analyst (LPA) Brittany Lovest and Judy Laureano conducted an unannounced 3 year Required Inspection at Temple Isaiah Pre-school Center. LPAs met with Director Avital Etehad. LPAs observed 118 children being supervised and cared for appropriately by 28 staff. Facility hours of operation are Monday – Friday, 8:00am – 5:00pm. LPAs toured the facility indoors and outdoors for a Health and Safety Inspection. Capacity and limitations as specified on the license are being maintained.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

All children are always under visual supervision of a teacher. The CCC is in compliance with Title 22 regulations regarding Staff to Student ratios.

There are no pools, ponds, Jacuzzis, spas or any other bodies of water on the property. There are no firearms or ammunition allowed or stored on the premises.

LPAs inspected the classrooms and observed age-appropriate toys, books and furnishings. Furniture and equipment are in good condition, free of sharp, loose or pointed parts. Playground equipment is in safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. Director states the sand is raked daily for sanitary purposes.

Teachers are responsible for the day-to-day cleaning and the facility utilizes custodial services that assist with cleaning and disinfecting of classrooms and outdoor space. During inspection LPAs observed an unlocked cabinet with cleaning solutions under the sink in the Butterfly classroom and the STEAM Classroom. Director states these areas are usually locked with a safety latch while children are present. Based on observation and interview the licensee did not comply with Building and Grounds regulation, which poses a potential health safety risk to children in care. Type B deficiency cited see LIC 809D.

All toilets and handwashing facilities are in safe and sanitary operating condition. Water temperature, toilet paper, paper towels, safety and sanitation were inspected floors in the facility are clean and safe.

All kitchen, food preparation and storage areas are clean, free of litter/rubbish and free of rodents/vermin. All food is protected against contamination and any contaminated food is discarded immediately. Solid waste storage containers have tight-fitting covers and are in good repair. Facility provides snacks and families are responsible for providing meals in adequate packing, eg. Ice packs in lunch bags and/or thermos.Drinking water is available both indoors and outdoors. Children bring in their own water bottle and meals from home. LPAs observed snack menu posted.

During the inspection of the kitchen area in the Hungry Caterpillar classroom, LPA Lovest observed a knife stored on a snack/storage cart accessible to children in care. The Director immediately relocated the knife to an out of reach locked cabinet. Based on LPA Lovest’s observation the licensee did not comply with Building and Grounds regulation by having a hazardous item accessible to the classroom children, which poses a potential health safety risk to children in care. Areas around high climbing equipment, swings and slides have cushioning material to absorb falls. The facility is free of flies, insects and rodents. Facility has a centralize fire alarm and smoke detector system that includes a sprinkler system. Each preschool rooms has a fully charged 3A:40B:C Fire Extinguisher. LPA Lovest observed a working carbon monoxide detector in all classrooms. LPAs reviewed the Disaster, earthquake and fire drill log. Earthquake drill log was completed on 10/22/2024 and Fire Drill log was completed on 9/30/2024.

Facility uses an online platform, Playground, to communicate with parents regarding enrollment forms, facility updates and any other information that needs to be disseminated.

LPA Lovest reviewed 10 children files and observed the files to be in compliance including but not limited to current contact information of parents and authorized representatives, and authorization for medical treatment, signed Parent’s Rights and signed Personal Rights receipts.

LPA Lovest reviewed 10 employee files which were found to be in compliance with immunization for childcare providers and LPAs observed CPR/First Aid as required for opening and closing staff. LPAs reminded Director that Mandated Reporter training, Child Care provider course is required and certificates are to be renewed every 2 years following the date on which the initial or last training certificate was received. LPAs advised to make CCL forms more accessible for staff files.

LPAs reviewed records and Criminal Record Clearance for the adults who were present during today’s visit. During the inspection LPA Laureano spoke with, front desk and confirmed that head of maintenance C. Espinola and maintenance employee M. Sanchez are current employees at the facility and based on Guardian print out individuals do not have a clear criminal record clearances associated to the facility. LPAs reviewed facility roster and verified via Guardian, individual F.Pereira did not have valid fingerprint clearance at the time of the visit. However, the staff has been associated with facility since August 26, 2024. LPAs cited a Type A deficiency, and a Civil Penalty was assessed.

LPA Lovest informed facility representative, Avital Etehad that this report date 4/2/2025 documents one Type A Citation. Type A citations shall be posted for 30 consecutive days as there is/are immediate risk to the health and safety or personal rights of children in care. Also, LPA Lovest informed director to provide a copy of this licensing report dated 4/2/2025 that documents any Type A citation to parents/ guardians of all children currently enrolled by the next business day or the next day children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgment of the Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child’s file for verification.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Incidental Medical Services – IMS are not currently being provided. LPAs observed and inspected the areas where the medication is kept. For IMS information see PIN 22-02-CCP. Capacity and limitations as specified on the license are being maintained. Facility has a capacity of 306.

The name of the childcare center director or fully-qualified teacher(s) designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. All children are under supervision, including visual supervision, of a teacher at all times.

Director Avital was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA Lovest reminded the staff to access the Community Care Licensing website www.ccld.ca.gov for access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Childcare Lead Poisoning Facts, Forms and Regulations. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations and/or Health and Safety Codes, 3 Deficiencies were cited. Please see LIC 809D.

During the exit interview the report was reviewed, and a copy was provided to Director Avital Etihad.
